Between the first day of April and the 31st day of October for monthly periods on all streets in the City, all cars shall be parked only on the odd-numbered side of the street during odd-numbered months and only on the even-numbered side of the street during even-numbered months. The number of the month on the first day of said month at 10:00 a.m. determines the side of the street upon which parking is allowed.

B. 
In those streets or public places on which parking is restricted, as herein provided, and which are within the congested district, the restrictions as to parking meters shall apply Monday through Friday from 8:00 a.m. to 6:00 p.m., Sundays and holidays excepted. No person shall park any vehicle on any street or public place, other than designated off-street parking lots, within the congested district between the hours of 2:00 a.m. and 7:00 a.m.

A. 
Anything contained in § 290-24 of this article notwithstanding and in order to provide for snow removal, ice control, street cleaning and maintenance, when signs have been posted giving notice thereof, there shall be no parking between the hours and on the days of the week specified by said signs on the streets enumerated by § 290-24C, D, E and F, of this article.
B. 
In order to provide for snow removal, ice control, parking lot cleaning and maintenance when signs have been posted giving notice thereof, there shall be no parking between the hours and on the days of the weeks specified by such signs in any off-street parking lot owned or operated by the City of Jamestown.
C. 
When any vehicle is parked in violation of any of the provisions of this section, such vehicle may be ordered removed by the Chief of Police or authorized personnel under his command.
No person shall park a vehicle as follows:
A. 
Within any public alley for a longer period than is required to load or unload merchandise or to take on or discharge passengers. The foregoing notwithstanding, parking shall be permitted on the westerly side of School Alley between Prather Avenue and the Foote Avenue Arterial Highway.
B. 
Within 10 feet of any pump used for the sale of gasoline, when such pump is situated on the sidewalk or near the curb.
C. 
Within any space designated and set apart as a cab stand or bus terminal.
D. 
In front of a main entrance of any school, hotel or theater.
E. 
Within any area designated as a fire lane on private property in Jamestown, New York, owned by Victor Management Corporation and being known as the "Holiday Inn of Jamestown."
F. 
Within the area designated as Bradmar Circle on private property in Jamestown, New York, owned by Bradmar Village Realty and known as "Bradmar Village."
G. 
Within any area where parking is designated as prohibited on private property in Jamestown, New York, owned by Bradmar Village Realty and known as "Bradmar Village."
H. 
Within any area designated as a fire lane on private property and located at 23 through 41 South Main Street, Jamestown, New York, and owned by Cosima Corporation.
I. 
On Shirley Lane within 75 feet of its intersection with Fairmount Avenue.

A. 
Removal and storage of certain parked or abandoned vehicles shall be as provided in Subsection A(1) through (13):
(1) 
When any vehicle is parked or abandoned on any highway within the City during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or abandoned, said vehicle may be ordered removed by order of the Police Chief or authorized personnel under his command.
(2) 
When any vehicle is found unattended on any highway within the City where such vehicle constitutes an obstruction to traffic, such vehicle may be ordered removed by the Police Chief or authorized personnel under his command.
(3) 
When any vehicle is parked or abandoned on any highway within the City where stopping, standing or parking is prohibited, blocking any driveway or yellow curbline, such vehicle may be ordered removed by the Police Chief or authorized personnel under his command.
(4) 
When any vehicle is found parked on any highway or other public property in the City and such vehicle is unregistered or without number plates, such vehicle may be ordered removed by the Police Chief or authorized personnel under his command.
(5) 
When any vehicle is found parked in violation of any of the provisions of this § 290-26, such vehicle may be ordered removed by the Police Chief or authorized personnel under his command.
(6) 
When any vehicle is found parked on any industrial or commercial property or property of the Jamestown Public Schools, Jamestown Community College or property owned by any religious, charitable or not-for-profit organization without the actual or implied consent of the owner or authorized agent of the owner thereof, such vehicle may be ordered removed by the Chief of Police or authorized personnel under his command, provided that such removal is requested in writing by the owner or authorized agent of the owner of such property and further provided that legible signs shall have first been erected on such property by such owner or authorized agent giving notice that an unauthorized vehicle parked on such property shall be removed at the expense of the owner of such vehicle.
(7) 
When any vehicle is found parked on any residential property without the consent of the owner thereof, such vehicle may be ordered removed by the Chief of Police or authorized personnel under his command upon the written request of such owner or authorized agent.
(8) 
When it is determined by the City Clerk/Treasurer, any police officer or parking enforcement officer that any vehicle has $100 or more of delinquent parking tickets that have been issued to the vehicle for violation of the parking regulations of the City of Jamestown and that such tickets have not been paid, satisfied or disposed of, the vehicle shall be removed to a place of safety within the City of Jamestown either by towing or otherwise be removed or conveyed to and impounded in any place designated by the Chief of Police/Director of Public Safety, or immobilized in such a manner as to prevent its operation, except that no such vehicle shall be immobilized by any means other than by use of a device or other mechanism which will cause no damage to such vehicle unless it is moved while such device or mechanism is in place. When towed, the vehicle so removed shall be retained under the custody of the City of Jamestown Police Department or its designated representative until such time that said parking violations have been paid, satisfied or disposed of. Once taken into custody, the last registered owner of said vehicle shall be liable.

(9) 
It shall be the duty of the police officer with the assistance of the parking enforcement officer removing or immobilizing such motor vehicle or under whose direction such motor vehicle is removed or immobilized to inform, as soon as practicable, the City Clerk/Treasurer, who shall in turn inform by telephone (if possible) and by first-class mail the owner of the impounded or immobilized vehicle of the nature and circumstances of the prior unsettled parking violations summonses for which or on account of which such vehicle was impounded or immobilized. In any case involving immobilization of a vehicle pursuant to this subsection, such police officer or parking enforcement officer shall cause to be placed on such vehicle, in a conspicuous manner, a notice sufficient to warn any individual to the effect that such vehicle has been immobilized and that any attempt to move such vehicle might result in damage to such vehicle.

(10) 
The owner or person entitled to possession of such vehicle shall pay a towing charge and storage charge for each day or fraction thereof after the first 24 hours that such vehicle is in the custody of the City of Jamestown as provided in Chapter 175, Licenses and Permits.[1]

(11) 
These charges shall be in addition to the fines and penalties, if any, hereinafter provided within this article for vehicles that are left standing, stopped or parked illegally.
(12) 
Such towing charges shall be paid to the City Clerk/Treasurer’s office during the hours such office is open, weekends and legal holidays excepted.

(13) 
Before the owner or person in charge of such vehicle shall be permitted to remove the same from the custody of the City of Jamestown, he shall furnish evidence of his identity and ownership or right to possession of such vehicle and shall sign a receipt and release in such form as the City Clerk/Treasurer’s office and Jamestown Police Department shall prescribe; provided, further, that such owner or person entitled to possession of such vehicle may not obtain the release of such vehicle before paying the towing, storage, outstanding parking summonses and related penalties and other fees hereinabove mentioned.

B. 
Whenever any vehicle is ordered removed by the Chief of Police/Director of Public Safety or authorized personnel under his command as provided by Subsection A(1) through (13) above, the expense of vehicle removal and storage shall be the responsibility of the owner of such vehicle, and the City of Jamestown shall have no liability for such expenses, nor shall the City of Jamestown have any liability for any damages whatsoever which may result from the authorized removal of any vehicle pursuant to any of the provisions of Subsection A(1) through (13) above.
C. 
Removal and storage of certain parked or abandoned vehicles shall be of a last resort after proper notification to the recorded owner of the vehicle of delinquent parking tickets that have been issued to the vehicle for violation of the parking regulations of the City of Jamestown and that such tickets have not been paid, satisfied or disposed of and after proper publication in the City's designated newspaper.
A. 
Anyone seeking modification of the application of the provisions of §§ 290-21 through 290-25, referred to in this section as the "Alternate Parking Ordinance," on a certain designated street shall do so by submitting a request either individually or by petition to the Department of Public Works Committee and the Public Safety Committee of the City of Jamestown.
B. 
Upon receipt of a request for modification of the provisions of the Alternate Parking Ordinance on a designated street, the Department of Public Works Committee and Public Safety Committee shall automatically table the request until the next regularly scheduled meeting of the Department of Public Works Committee.
C. 
During the period that a request is tabled as aforesaid, the request shall be investigated by the Director of Public Works, who shall obtain from the Chief of Police/Director of Public Safety and the Deputy Fire Chief recommendations on the request and the reasons therefor.

D. 
At the next regularly scheduled meeting of the Department of Public Works Committee following the request for the modification of the provision of the Alternate Parking Ordinance on a designated street, the Department of Public Works Committee shall make its recommendation based upon the recommendations of the Director of Public Works, the Chief of Police/Director of Public Safety and the Deputy Fire Chief and shall forward its recommendation together with the reasons therefore to the Chairperson of the Public Safety Committee.

E. 
The Chairperson of the Public Safety Committee shall, at the next regularly scheduled meeting of the Public Safety Committee after receipt of the recommendations of the Department of Public Works Committee, bring the matter before the Public Safety Committee, which Committee shall in turn make its recommendations, together with its reasons therefor, to the City Council as a whole.
F. 
The City Council as a whole may then act upon the request for modification of the provisions of the Alternate Parking Ordinance on a designated street or may refuse to act upon such request at its pleasure.
G. 
In the event that the recommendation of the Department of Public Works Committee or the Public Safety Committee is to deny the request for modification of the application of the Alternate Parking Ordinance on a certain designated street, there shall be no requirement that the request be considered by the City Council as a whole.
Upon recommendation of the Department of Public Works Committee and the approval of the Director of Public Works, a special reserved parking space permit may be issued to a person engaged in mercantile business which requires the loading and unloading of bulky parcels and has no other means of access to his place of business except through the space covered by such permit.
The Director of Public Works shall determine the size and location of such reserved parking spaces, designated pursuant to § 290-29. No vehicle shall occupy such space for more than 30 minutes, nor shall any vehicle occupy such space except when actually engaged in loading or unloading.
All vehicles shall be parked parallel with the curb and not more than 12 inches from the curb, except on such streets where the Chief of Police has properly marked parking spaces diagonally or at right angles to the curb, where a vehicle shall be parked by heading into the curb and within the lines established by the Chief of Police.

A. 
Parking in the congested area shall be limited to the time stated on the instruction plate on the parking meter or on the sign within the specified parking zone.
B. 
There is hereby established within the Central Business District a two-hour free parking zone, which zone shall include Third Street between Washington Street and Spring Street and Pine Street, Main Street, and Cherry Street between Second Street and Fourth Street. Between the hours of 9:00 a.m. and 5:00 p.m. each weekday, no person shall park a motor vehicle within the aforesaid free parking zone for a period of time in excess of a cumulative time of two hours per day within the zone.
