A certain document, three copies of which are on file in the offices of the Township of Exeter, being marked and designated as the "International Fire Code," the 2006 version, as published by the International Code Council, including Appendix Chapters E, F, and G, be and is hereby adopted as the Fire Code of the Township of Exeter, in the Commonwealth of Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the Township offices are hereby referred to, adopted and made part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 150-16 of this article.
A. 
Penalties.
Section 903
(a)
Violation of act.
(1)
Any individual, firm or corporation that violates any provision of this act commits a summary offense and shall, upon conviction, be sentenced to pay a fine of not more than $1,000 and costs.
(2)
Each day a violation of this act continues shall be considered a separate violation.
(b)
Disposition of penalties. The amount of the penalty shall be forwarded to the entity with enforcement jurisdiction.
The geographic limits referred to in certain sections of the International Fire Code are hereby established as follows:
Section 3204.3.1.1 (geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited): locations and limitation as determined by the Fire Official or authority having jurisdiction (AHJ).
Section 3404.2.9.5.1 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited): locations and limitation as determined by the Fire Official or authority having jurisdiction (AHJ).
Section 3406.2.4.4 (geographic limits in which the storage of Class I and Class II liquids in aboveground storage tanks is prohibited): locations and limitation as determined by the Fire Official or authority having jurisdiction (AHJ).
Section 3804.2 (geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas): locations and limitation as determined by the Fire Official or authority having jurisdiction (AHJ).
A. 
The Fire Prevention Code shall be enforced by the Fire Department and the Fire Prevention Division of the Township of Exeter.

B. 
The person in charge of the Fire Prevention Division shall be designated as the Fire Marshal or Fire Official and shall be appointed by the Township Manager and approved by the Supervisors of the Township of Exeter.
C. 
The Fire Marshal or Fire Official (heading the department) shall recommend to the Township Manager and Supervisors of the Township of Exeter the employment of such assistants as are deemed appropriate to enforce the Fire Prevention Code.
D. 
The Fire Marshal or Fire Official shall supervise his/her assistants and may detail such assistants to perform such functions as are appropriate or necessary for effective enforcement of the Fire Prevention Code.
E. 
No person shall in any way obstruct or prevent or attempt to obstruct or prevent the Fire Marshal or Fire Official in the discharge of his/her duties by denying or attempting to deny access to any premises owned or occupied by him/her or by failing or refusing to furnish correct information requested by him/her in the investigation into the cause, origin or circumstances of any fire. Any person violating any of the provisions of this section shall, upon conviction thereof, be sentenced to pay a fine as determined by the District Justice.
Nothing in this amendment of Ordinance Nos. 569 and 618 or in the Fire Code adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited herein, nor shall any just or legal right or remedy of any character be lost, impaired or affected by the amended article.
