Any person who violates this chapter shall be
subject to a civil penalty not to exceed $10,000 per day of such violation.
The offender shall be given written notice of the violation, which
shall include a description of the nature of the violation. The notice
shall include a time schedule for compliance, which time schedule
shall take into consideration the character and seriousness of the
violation. Nothing contained herein shall prevent the city from taking
any other action necessary to prevent a violation of this chapter,
including, without limitation, ex parte temporary judicial relief.
Notice shall also be given to the NHDES within
10 days of commencement of any action hereunder.
Any person who causes a discharge which obstructs,
damages or otherwise impairs the wastewater facilities may be assessed
a charge by the city for the work required to repair or clean the
affected facilities. In addition, the city may terminate water service.
Any person who knowingly makes any false statements,
representation, record, reports, plan or other document filed with
the city or who falsifies, tampers with or knowingly renders inaccurate
any monitoring device or method required under this chapter shall
be punished by a fine of not more than $100,000.

Any person(s) who shall wantonly or maliciously
(purposely or knowingly) injure any part of any sewer system, conveyance,
and discharge system, or sewage disposal shall be liable to pay treble
damages to the owner thereof and shall be guilty of a misdemeanor
if a natural person, or a felony if any other person.
