A. 
All dogs in the unincorporated area of the Town of Ossining must be licensed with the Town Clerk by the age of four months and required to present a current certificate of rabies vaccination at the time of licensing or the renewal of an existing license. The Village of Ossining Board of Trustees has adopted a resolution pursuant to New York Agriculture and Markets Law § 109(b) directing that applications for dog licenses within the Village of Ossining shall be made to the Town Clerk of the Town of Ossining, in accord with the Town Code of the Town of Ossining. For so long as this resolution remains in full force and effect and to the greatest extent permitted by law, dog licensing for those within the Village of Ossining shall be in accordance with this Article II.
B. 
All dogs required to be licensed under Subsection A must be licensed by June 1 of each calendar year and the license will remain in effect until May 31 of the following calendar year. It is the obligation of the dog owner to renew the dog license before June 1 of each calendar year. There will be an annual fee for the license that will be set by resolution of the Town Board as amended from time to time.
C. 
For those who get licenses for the first time after June 1, the license fee will be prorated for the number of months for which the license will be valid before expiring the following May 31. The dog must then be licensed by June 1 of every following year.
D. 
At the same time that a dog is licensed with the Town Clerk, they will also be required to register for the Cedar Lane Dog Park and the Dog Run at Ryder Park as set forth in Article III. There will not be a separate fee for registering dogs of the unincorporated Town or the Village of Ossining and will be an added benefit for licensing the dog. This requirement shall not apply to dogs between the ages of eight months and 10 years that are not spayed or neutered, as these dogs are not permitted to use the dog park as set forth in § 74-21.
The fee for a neutered male or spayed female dog shall be set by the Town Board in the Town Fee Schedule or by resolution. It shall include a state assessment pursuant to § 110-3 of the New York State Agriculture and Markets Law, and additional funds for remuneration as provided for by § 110-4(a) of the Agriculture and Markets Law.
The fee for an unneutered male or unspayed female dog shall be set by the Town Board in the Town Fee Schedule or by resolution. It shall include a state assessment pursuant to § 110-3 of the New York State Agriculture and Markets Law, and additional funds for renumeration as provided for by § 110-4(a) of the Agriculture and Markets Law.
When the Town Board determines the need for a dog enumeration, a fee set by the Town Board in the Town Fee Schedule or by resolution shall be assessed to all dogs found unlicensed or renewed at the time enumeration is conducted.
The Town of Ossining will not be issuing purebred or kennel licenses. All dogs will be licensed individually as per the fee system stated above.
The Town of Ossining requires licenses for all dogs living or harbored within the unincorporated area of the Town of Ossining; however, the Town fee for licensure of all types of services dogs listed in § 110-2 of the Agriculture and Markets Law, including, but not limited to, guide dogs, service dogs, hearing dogs, and detection dogs, is waived.
The Town of Ossining does not allow the licensing of dogs by a shelter. The shelter must notify the adoptive owners of their responsibility to license any dog who will be living within the unincorporated area of the Town of Ossining with the Town Clerk within 30 days of adoption. The shelter must provide Ossining with a list of adoptive owners monthly.
Residents of the unincorporated area of the Town of Ossining who are 60 years of age and older shall be exempt from any Town of Ossining local fees incorporated within the fees enumerated in §§ 74-11 to 74-15.
It shall be a violation punishable as provided in Article I, § 74-8, of this chapter for any owner to fail to license any dog. Each week a dog shall remain unlicensed shall constitute a separate violation hereunder.
