This chapter shall be cited and may be referred to hereinafter as the
"Discharge of Firearms Law of the Town of Ossining."
As used in this chapter, the following terms shall have the meanings
indicated:
FIREARM
Includes a weapon which acts by the force of gunpowder or from which
a shot is discharged by the force of an explosion, as well as an air rifle,
an air gun, a BB gun and a slingshot.
The Town Board of the Town of Ossining hereby adopts regulations governing
discharge of firearms. These provisions are adopted to protect the health,
safety and welfare of the residents of the Town of Ossining, pursuant to the
provisions of § 130, Subdivisions 15 and 26, of the Town Law.
No person shall discharge a firearm in that portion of the Town of Ossining
which is not in an incorporated village.
The provisions of this chapter shall not apply to:
A. A law enforcement officer in the performance of his official
duties.
B. The authorized use of a pistol, rifle or target range
approved by the Town of Ossining, but not within 500 feet of any dwelling
except with the permission of the owner of said dwelling, and provided that
said use will be conducted with all due regard for the safety of the surrounding
community.
C. The lawful use of a firearm in the defense of person
or property.
Any person discharging a firearm in violation of this chapter shall
be guilty of a violation punishable by a fine not to exceed $250 or imprisonment
for not more than 15 days, or both.
