No person shall stop, stand, or park a vehicle in any designated bicycle lane on any public street or highway within the Borough of Lansdowne. This prohibition shall not apply to: 1) authorized emergency vehicles while engaged in official duties; 2) public utility or municipal services vehicles while performing maintenance or repairs; or 3) vehicles actively engaged in loading or unloading passengers where no adjacent curbside space is reasonably available, and only for the minimum time necessary to complete such activity.

A. 
From and after the passage of this section, it shall be unlawful for any motor vehicle except as hereinafter specified to be parked on the streets of the Borough during the period between 2:00 a.m. and 6:00 a.m.
B. 
Owners of automobiles, motorcycles and trucks, hereinafter "vehicle(s)," that occupy no more parking space than that provided by the standard parking space allotted on the streets of the Borough may avail themselves of the privileges of parking on said streets between the hours of 2:00 a.m. and 6:00 a.m. within reasonable proximity of property of which the owner or possessor of said vehicle ("vehicle owner") is, or is employed by, the owner or tenant, provided that said owner makes application to the Chief of Police of the Borough of Lansdowne for a parking permit on a form to be supplied by the Chief as specified hereinafter, pays the required fee as provided hereinafter, obtains the approval of the Chief of Police and receives a permit and displays the permit on the vehicle as directed by the Chief of Police. All such vehicles must bear current license tags and current inspection sticker issued by the Commonwealth of Pennsylvania.
C. 
The Chief of Police of the Borough of Lansdowne shall upon request provide an application form for the parking permit herein provided. The applicant shall state on the form his or her name, address, apartment number (if applicable), the make, model, year, color and license number and name of the registered owner of the vehicle for which the permit is sought, as well as the parking location. The application should be accompanied by the application fee as hereinafter provided. Upon receipt of the application properly completed and executed, the payment of the proper fee, and provided that all provisions of this section have been complied with, the Chief of Police shall issue the applicant a parking permit if there is parking space available at the parking location requested. Overnight parking permits shall be limited to not more than five per dwelling unit. For purposes hereof, "dwelling unit" shall mean a residence that includes cooking, sleeping and bathroom facilities and that is to be occupied on a year-round basis.

D. 
All streets will be posted with signs reading "No parking 2:00 a.m. to 6:00 a.m."
E. 
The fee for a parking permit shall be as set forth from time to time by resolution of the Borough Council for each calendar year, prorated for the balance of the calendar year.
F. 
The Chief of Police will pay over, deliver and account for all moneys received under this section to the Borough Manager on a monthly basis.
G. 
Any person who shall violate any subsection of this section shall, upon conviction before a Magisterial District Judge, pay a fine of not less than $5 and not more than $25, plus costs, or on default thereof shall be imprisoned for a period not to exceed 30 days. Each day that this section is violated shall constitute a separate offense.
H. 
Each police officer or parking enforcement officer shall also place on each vehicle reported for violation of any of the provisions of this section a notice to the owner or operator thereof that the vehicle has been parked in violation of the provisions of this section and instructing such owner or operator to pay, within 10 days, a penalty of not less than $2 and not more than $50 to the police headquarters of the Borough of Lansdowne. The exact amount of the fine may be determined by resolution of the Borough Council from time to time. Failure to pay within the prescribed time will result in an additional penalty of $10 for each violation.

A. 
The Borough Council does hereby prohibit the parking of motor vehicles of any kind, except those actually involved in the performance of a necessary emergency service, during the designated time period listed below on the following identified and designated public or private property:

(1) 
Violet Lane (twenty-four-hour no parking on both sides).
(2) 
East Windermere Terrace from Baltimore Avenue to a point extending 470 feet south from Baltimore Avenue (no parking on west side only from 7:00 p.m. to 7:00 a.m.).
(3) 
West Windermere Terrace from Baltimore Avenue to a point extending 400 feet south from Baltimore Avenue (no parking on west side only from 7:00 p.m. to 7:00 a.m.).
B. 
The Fire Marshal of the Borough of Lansdowne is hereby authorized and directed to post signs on the aforesaid identified and designated public or private properties, said signs to read "No parking by order of the Fire Marshal." If, in the judgment of the Fire Marshal, such signs are not sufficient in specific situations to give proper notice, he is also authorized to have boundary lines painted marking the area where parking is prohibited and to have painted the words "Fire Lane" in letters up to three feet high on the area where the parking is prohibited.
C. 
By further reference and amendment to this section, the Borough Council may add to or subtract from the list of areas where parking is prohibited under this section and where the Fire Marshal shall exercise the duties and authority specified in this section.
D. 
In addition to the duties and authority given to the Fire Marshal by other provisions of this section, the Fire Marshal of Lansdowne Borough is hereby given authority and discretion during the actual duration of any actual fire or other temporary emergency to post temporary signs reading "No parking — temporary fire regulation by order of the Fire Marshal" on public or private property whenever he shall determine that temporarily the parking of motor vehicles on such property would create an unreasonable, temporary hazard to public health, safety and welfare in that such temporary parking would unreasonably interfere with the lawful and necessary operation of the Fire Department or hamper the egress and protection of occupants of buildings and their property in case of fire or other temporary emergency. Upon the termination of such fire or other temporary emergency, the Fire Marshal shall remove the signs.
E. 
Any person who shall violate this section by parking or allowing to remain parked a motor vehicle where and when the parking of such vehicle is prohibited by this section shall, upon summary conviction thereof, be sentenced to pay a fine of $15 and costs of prosecution upon conviction. Such fines or penalties shall be collected as like fines or penalties are now by law collected.

A. 
It is the purpose and intent of this section to restrict the parking and stopping of certain defined commercial vehicles on the public streets and private property of certain defined areas of the Borough of Lansdowne to promote safety and improved surveillance, to protect residential areas from the burden and intrusion of commercial activities and to promote and preserve property values.
B. 
Except while actually loading or unloading and rendering requested service to property owners or tenants in the Borough of Lansdowne, it shall be unlawful for any person to park or stop for a period exceeding one hour any commercial vehicle (as defined in this section) in any area of the Borough of Lansdowne zoned residential district under the Lansdowne Zoning Ordinance of 1985[1] and any subsequent amendments thereto either on the public streets or on private property unless such vehicle is fully enclosed in a garage. This prohibition shall not apply to vehicles serving official Borough purposes, public school purposes, fire company purposes or public utility purposes (or to contractors actually erecting or repairing buildings in the Borough).

C. 
For the purpose of this section, "commercial vehicle" is hereby defined to include all and any truck tractor, trailer, or tractor-trailer combination or any other vehicle usable for commercial purposes having the registered gross or combined weight classification of Class 3 or higher (7,001 pounds or higher) as set forth in the Pennsylvania Motor Vehicle Code of 1976, as amended, 75 Pa.C.S.A. § 1916.
D. 
Any person violating any provision of this section shall be guilty of a summary offense and, upon conviction thereof, shall be sentenced to pay a fine not exceeding $300 or to undergo imprisonment for a period not exceeding 90 days, or both such fine and imprisonment. Each day such violation continues shall constitute a separate offense and shall be punishable as such.
