A. 
Established. The Town of Ledgeview hereby establishes an Official Traffic Map dated April 2, 2012, for the Town upon which shall be indicated "no parking" areas, "restricted parking" areas, stop signs, arterial intersections, yield signs, special speed limits, one-way highways, school crossings and all other restrictions or limitations contained in this chapter, as from time to time amended or modified by the Town when the laws of the state require the erection or use of official traffic control devices to enforce such restrictions or limitations.

B. 
Violations prohibited. When official traffic control devices giving notice of the restrictions, prohibitions and limitations shown on the Official Traffic Map are erected and maintained in accordance with this section, a violation of the restriction, prohibition or limitation shown on the Official Traffic Map shall be a violation of this chapter.
C. 
Maintenance and display. A copy of the Official Traffic Map shall be maintained and displayed in the office of the Public Works Department.
D. 
Additions. The Town Board may from time to time make additions to or deletions from the Official Traffic Map, and the Public Works Department shall keep such Official Traffic Map current.

The Town Board, pursuant to § 349.11, Wis. Stats., may establish speed limits on Town roads different from the statutory speed limit. Such speed limits shall be based upon an engineering and traffic study and shall be shown on the Town of Ledgeview Official Traffic Map established under § 118-1.

A. 
Purpose. The purpose of this section is to provide a uniform method to direct heavy truck traffic away from public streets and roads in the Town of Ledgeview that are structurally unsuited for such traffic or where such traffic would adversely impact the safety and welfare of residential areas.
B. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
AUTHORITY
Any person or persons authorized by the Town of Ledgeview to be responsible for road maintenance in the Town of Ledgeview.
HEAVY TRUCK TRAFFIC
All vehicles operating completely on pneumatic tires and all vehicles or combination of vehicles, other than motor buses, designed or used for transporting property of any nature and having a gross weight of more than 8,000 pounds.
C. 
Special or seasonal weight limitations. Pursuant to the authority of § 349.16, Wis. Stats., the Town Board hereby designates the Public Works Operator as the "authority" in charge of maintenance of streets and highways in the Town and authorizes such, when necessary, to impose special weight limitations on any highway or street or its portion within the Town which, because of weakness of the roadbed due to deterioration or climatic conditions or other special or temporary condition, including, but not limited to, damage to the street caused by heavy volumes of truck traffic or damage to streets not completely constructed, would likely be seriously damaged or destroyed in the absences of such special limitation. The Public Works Operator shall, upon making determinations to impose special weight limitations in accordance herewith, erect signs on or along the highways or streets on which it is desired to impose the limitation sufficient to give reasonable notice that a special weight limitation is in effect and the nature of that limitation. All weight limitation signs and their erection shall comply with rules of Wisconsin Manual on Uniform Traffic Control Devices.
D. 
Routes prohibited to heavy truck traffic. It shall be unlawful for any person or company to operate any motor vehicle on the following Town of Ledgeview roads (having a gross weight of (more than 8,000 pounds) except when necessary for the purpose of obtaining orders, delivering or moving supplies or other necessary commodities to or from any place of business or residence fronting on any such road, and except when necessary for the propose of leaving or returning to the terminal or place of garaging of any such vehicle. When it is necessary for the operator of such a vehicle to travel on a street prohibited to heavy truck traffic, such operator shall leave and reenter the route at the point closest to the immediate destination.

Scray Hill Road from 2045 Scray Hill Road to Lime Kiln Road (CTH V);
(10) 
Lime Kiln Road (CTH V) from Dickinson Road (CTH G) to Scray Hill Road;
(11) 
Pine Grove Road, in its entirety;
(12) 
Glenmore Road, in its entirety;
(13) 
Hidden Valley Lane, in its entirety;

Hidden Valley Court, in its entirety;
(15) 
Elmview Road from Pine Grove Road to Dutchman Road/Creekend Lane;

E. 
Special weight limits.
(1) 
Pursuant to § 349.16, Wis. Stats., the authority responsible for road maintenance in the Town of Ledgeview may impose special weight limitations on any such road or a portion thereof which, because of weakness of the roadbed, climatic conditions, or to promote the general welfare of the public, or other special or temporary condition, would likely seriously damage or destroy the road in the absence of such limitations.
(2) 
Pursuant to § 349.16, Wis. Stats., the authority may exempt vehicles carrying certain commodities specified by the authority or which are used to perform certain services specified by the authority from the special weight limitations which are imposed or may set different weight limitations than those imposed.
(3) 
Subject to the conditions and limitations set forth in § 346.16(3), Wis. Stats., any vehicle that is used to transport material pumped from a septic or holding tank shall be exempt.
F. 
Sign placement. Imposition of the prohibited and restricted routes and the special weight limitations shall be done by erecting signs on or along the road on which such limitations apply.

A. 
Publicly owned property. The operation of recreational off-road motor vehicles is prohibited on all Town-owned parcels in the Town of Ledgeview.

A. 
Purpose. The purpose of this section is to enact the use and regulation of all-terrain/utility-terrain vehicles on all Town streets except as defined herein. This section does not pertain to golf carts.
B. 
Authority. Pursuant to and the adoption of the provisions of § 23.33 and Chs. 340 through 348, Wis. Stats., and Ch. NR 64, Wis. Adm. Code, and the provisions of this section, the operation of ATVs and UTVs, as defined in Subsection C below, shall be permitted on all Town streets except as defined herein.
C. 
Definitions. The definitions prescribed in § 23.33(1), Wis. Stats., shall apply to this section, and, as used in this section, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
A motorized vehicle as more particularly defined in § 340.01(2g), Wis. Stats.
ATV/UTV ROUTE(S)
Highway, road, street, or right-of-way designated for use by ATVs or UTVs by the Town.
UTILITY-TERRAIN VEHICLE (UTV)
A motorized vehicle as more particularly defined by § 23.3(ng), Wis. Stats.
D. 
UTV/ATV routes. All streets in the Town of Ledgeview are open to ATVs/UTVs unless specifically prohibited below and/or designated signage indicates that the street is closed to ATV/UTV traffic. The ATV/UTV Route Map is attached hereto and incorporated herein.
(1) 
The following streets are prohibited for ATV/UTV use:
(a) 
All county highways.
(b) 
All state highways.
(c) 
All federal highways.
(d) 
Ledgeview Road from Lone Oak Road to Creamery Road.
(e) 
Swan Road from Dickinson Road to Heritage Road.
E. 
Conditions and restrictions on operation. In addition to the provisions contained in § 23.33 and Chs. 340 through 348, Wis. Stats., and Ch. NR 64, Wis. Adm. Code, and as a condition for the use of ATV/UTV routes designated and authorized herein, the following conditions and restrictions shall apply to all ATV/UTV operators and passengers, as applicable:
(1) 
ATV/UTV operators shall observe all applicable rules of the road governing motorized vehicles while operating on Town streets in accordance with § 23.33 and Chapter 346, Wis. Stats.
(2) 
ATV/UTV operators or passengers under 18 years of age shall wear protective headgear which meets a minimum DOT standard ATV or motorcycle helmet with the chin strap properly fastened. Bicycle helmets do not meet this requirement.
(3) 
UTV operators and passengers shall have their seat belts fastened as defined in § 347.48, Wis. Stats.
(4) 
ATV/UTV operators shall not exceed posted Town speed limits. Where a different speed is posted by an official ATV/UTV speed limit sign, ATVs/UTVs shall abide by that limit.
(5) 
No person shall operate an ATV/UTV on any Town street from sunset to sunrise, except as permitted in § 23.33(4)(f), Wis. Stats.
(6) 
ATV/UTV operators shall not operate an ATV/UTV equipped with metal-studded tires and/or tire chains on or alongside any Town street.
(7) 
ATV/UTV operators shall be permitted to operate an ATV/UTV pursuant to § 23.33(4)(d)5, Wis. Stats., if the vehicle is an implement of husbandry or used exclusively for agricultural purposes.
(8) 
ATV/UTV operators shall be permitted to operate an ATV/UTV pursuant to § 23.33(4)(f), Wis. Stats., for the purpose of snow removal.
F. 
Licensing, Registration, and Insurance.
(1) 
ATV/UTV operators must hold a valid state-issued motor vehicle operator's license and shall display that proof to a law enforcement officer upon request.
(2) 
ATV/UTV operators born after January 1, 1988, shall hold a valid safety certificate, carry proof of a valid safety certificate and shall display that proof to a law enforcement officer upon request in accordance with § 23.33(5)b, Wis. Stats.
(3) 
ATV/UTV units shall be registered for public use in accordance with Wisconsin Department of Natural Resources (WDNR) regulations, and proof of registration shall be displayed as required by Wisconsin Statutes during operation.
(4) 
Insurance requirements. No person may operate an ATV/UTV or allow another person to operate their ATV/UTV on any Ledgeview street unless the owner of the ATV/UTV carries liability, and/or other insurances consistent with § 344.62, Wis. Stats. (motor vehicle liability insurance required). Insurance documentation shall be kept with each ATV/UTV that is operated on Ledgeview streets and shall display proof of documentation to a law enforcement officer upon request.
G. 
Disturbing the peace and nuisance activities.
(1) 
Cruising prohibited. No person shall, while operating an ATV/UTV, engage in the practice of cruising on any Town roadway. "Cruising" is defined as running all or part of the length of a roadway multiple times per day, back and forth, for any purpose other than departing or arriving at their destination.
(2) 
Exhaust system/muffler modifications prohibited. No person may operate any ATV/UTV on any Town street unless such ATV/UTV is equipped with a functioning muffler to prevent excessive or unusual noise and with a functioning spark arrester of a type approved by the U.S. Forest Service. All muffler systems shall not emit any noise greater than 96 decibels when measured on the "A" scale, measured in the manner prescribed in the reaffirmed 1998-07, Society of Automotive Engineers Standard J1287, Measurement of Exhaust Sound Levels of Stationary Motorcycles.
(3) 
Radios or electronic sound amplification devices. No person may operate or park an ATV/UTV vehicle while using a radio or other electronic sound amplification device emitting a sound from the vehicle that is audible under normal conditions from 75 feet or more, unless the electronic sound amplification device is being used to request assistance or to warn against an unsafe condition.
(4) 
ATV/UTV lighting. ATVs/UTVs equipped with additional adverse weather lamps, spot lamps, auxiliary lamps, or any other lamp on the front of the ATV/UTV that is capable of projecting a beam of intensity of more than 300 candlepower shall operate lights in accordance with § 23.33(6)(ch), Wis. Stats.
H. 
Penalty.
(1) 
Any forfeiture for a violation of this section shall conform to the forfeiture permitted to be imposed for violation of those similar Wisconsin Statutes or statures referenced in this section, as set forth in the Uniform Deposit and Misdemeanor Bail Schedule of the Wisconsin Judicial Conference, including any variations or increases for subsequent offenses, which schedule is adopted by reference. Reference Chapter 118 of the Town of Ledgeview Municipal Code, which has the adopted said applicable Wisconsin State Statutes.
(2) 
If the ordinance subsection has no corresponding state statute, the penalty for violation of any provision of this section shall be a forfeiture in accordance with § 1-16, Forfeiture schedule, Subsection A(7)(a), of the Town of Ledgeview Municipal Code.

Any person violating any provisions of this article shall be subject to a forfeiture and penalty as provided by Chs. 343 and 346, Wis. Stats.
