[Adopted 3-13-1978 by L.L. No. 1-1978 (Ch. 108 of the 1975 Ogdensburg
Municipal Code)]
Pursuant to § 22 of the General Municipal Law, the
City of Ogdensburg does hereby authorize the City Comptroller to file
a lien with the New York State Superintendent of Insurance with respect
to any fire insurance proceeds which may be due and owing upon any
real property within the City of Ogdensburg, County of Saint Lawrence,
State of New York, which is or has been delinquent with respect to
any real property taxes, assessments, special ad valorem levies or
municipal charges arising by operation of law.
All definitions of this legislation shall coincide with the
definitions provided in § 22 of the General Municipal Law.
The insured property owner shall be entitled to the release
or return of any amounts which he or she would otherwise be entitled
to claim if said insured property owner agrees, in writing, to restore
the affected premises to the same or an improved condition that it
was in prior to the time that the lien of the city arose. The city
shall be entitled to require a guaranty for the performance of such
an obligation on the part of a property owner.
