As used in this chapter, the following terms
shall have the meanings as indicated:
A person other than a parent to whom legal custody of the
juvenile has been given by court order or who is acting in place of
a parent or who is responsible for the care and welfare of the juvenile.
An individual who is under the age of 18 years.
Any place to which the public has access, including but not
limited to a public street, road, avenue, thoroughfare, sidewalk,
bridge, alley, plaza, shopping area, public transportation facility,
vehicle used for public transportation, parking lot and/or any other
public building, structure or area.

It shall be unlawful for any juvenile of any
age under 18 years to be on any public street or in a public place
in the Township of Boonton between the hours of 11:01 p.m. prevailing
time and 6:00 a.m. prevailing time unless accompanied by the juvenile's
parent or guardian, except as hereinafter provided.
It shall be unlawful for any parent or guardian to allow an unaccompanied juvenile to be on any public street or in any public place in the Township of Boonton during the prohibited times set forth in § 66-2 hereof, except in the manner and for the purposes specified in this chapter.

The provisions of this chapter shall not apply
if said juvenile is, after 11:01 p.m. and before 6:00 a.m.:
A.
Engaged in, or traveling to or from, a business or
occupation which the laws of the State of New Jersey authorize the
juvenile to perform.
B.
Engaged in an errand involving a medical emergency.
C.
Attending religious services, extracurricular school
activities, activities sponsored by a religious or community-based
organization or other cultural, educational or social events or in
direct transit to or from such events.
Should an emergency arise necessitating a juvenile
under the age of 18 years to be dispatched upon an errand requiring
his presence upon a street or other public place after the curfew
hour herein established, he shall have in his possession a note signed
by a person of his household over the age of 18 years stating the
nature of the errand, the necessity therefor, the place to which said
juvenile is to go, the time such note was issued and the time required
for such errand. The abuse of the provisions of this section shall
constitute a violation of the provisions of this chapter punishable
as hereinafter provided.
Any police officer is hereby authorized and
empowered to take into custody any juvenile who violates the provision
of this chapter; such officer shall forthwith return said juvenile
to his or her home and notify the parent or guardian of the violation.

Any person found guilty of having violated the provisions of this chapter shall perform community service and shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code, and if the juvenile's parents or guardians as well as the juvenile are found guilty of violating this chapter, the juvenile's parents or guardians shall perform community service together with the juvenile.
