No person, firm or corporation shall permit any open, unguarded, unattended
or abandoned hole, pit, well, cesspool, excavation or quarry, dangerous to
the health, safety or welfare of the public, to exist on or in any property
within the Township of Boonton.
The Township Committee, upon complaint being made to it of the existence of any condition as set forth in §
76-1 hereof, shall make an investigation of such complaint and condition, and, in the event that it determines that such condition does exist and that it is detrimental or dangerous to any person or persons, the Township Committee shall order the Township Clerk to notify the owner or owners of such property, in writing, and direct such owner or owners to abate or remove such condition within 30 days from the date of service of such notice, which notice may be served personally or by registered mail to the last known address of such owner or owners.
Should the person, firm or corporation violating any provision of §
76-1 fail to abate or remove the condition within 30 days after notification, as set forth in §
76-2, the Township Committee shall remove or cause to be removed such violation, and the cost thereof shall be assessed against such property and collected as provided by law for the payment and collection of unpaid taxes.
