A. 
The Division of Law shall consist of the following positions:
(1) 
A Municipal Attorney.
(2) 
An attorney who shall be identified as Attorney I.
(3) 
An attorney who shall be identified as Attorney II.
(4) 
A Chief Municipal Prosecutor. In addition to the Chief Municipal Prosecutor, there shall be a Second Municipal Prosecutor who shall serve as a Temporary Municipal Prosecutor in the event the Chief Municipal Prosecutor is unavailable. The Second Municipal Prosecutor shall be paid at the rate set forth in § 99-34 footnote b. The Chief Municipal Prosecutor may also designate additional Temporary Municipal Prosecutors, if deemed necessary, from the Passaic County Municipal Prosecutor list who shall also be paid at the rate set forth in § 99-34 footnote b.
B. 
The Division of Law shall be administered by the Municipal Attorney, who shall be appointed by and under the supervision of the Municipal Council and shall be responsible for the legal affairs of the City. All other employees of the Division of Law shall be appointed by the City Manager, upon recommendation of the Municipal Attorney.
