Editor's Note: This ordinance also repealed former Art. V, School Crossing Guards, adopted 1-8-1985 by Ord. No. 4947-85. In addition, Ord. No. 5318-88 provided that:   "The salaries, compensation and wages for the years 1989, 1990 and 1991 shall be paid commencing January 1 of each year in question, unless otherwise provided herein."

A. 
Those municipal employees hired by the City of Clifton and designated as school traffic guards be and the same are hereby created for the proper conduct and protection of the students of the City of Clifton, and the amount(s) enumerated hereinafter be and they are fixed, granted and ordered paid as regular hourly salaries and wages to the school traffic guards now or hereafter in the office of employment enumerated, and continuing thereafter unless and until otherwise amended, revised or supplemented by and in accordance with law as follows:

Crossing guards shall have steps in accordance with the applicable collective bargaining agreement.

A. 
Hourly salaries shall be paid in equal semimonthly installments.
B. 
Direct deposit.

(1) 
All permanent employees and elected public officials who receive compensation from the City of Clifton are mandated to have direct deposit of their compensation as of July 1, 2017, in accordance with Chapter 28, P.L. 2013, as defined under N.J.S.A. 52:14-15f(b) (including paperless online pay stubs and W-2s).
(2) 
Seasonal and temporary employees who are employed by the City of Clifton are exempt from the direct deposit mandate.
(3) 
Municipal employees may request, in writing, an exemption from the direct deposit mandate to the City of Clifton's Personnel Director. Such requests will be presented to the City Council within 30 days. The City Council may grant such an exemption by resolution and only for good cause.
A. 
There shall be added to and made a part of the remuneration to each guard an amount equal to 2 1/2% of the salary or wages fixed for each such person upon the completion of five years of cumulative service in and for the City of Clifton; an amount equal to 5% of the salary or wages fixed for each such person upon the completion of 10 years of cumulative service in and for the City of Clifton; an amount equal to 7 1/2% of the salary or wages fixed for each such person upon the completion of 15 years of cumulative service in and for the City of Clifton; an amount equal to 10% of the salary or wages fixed for each such person upon the completion of 20 years of cumulative service in and for the City of Clifton; and an amount equal to 12 1/2% of the salary or wages fixed for each such person upon the completion of 25 years of cumulative service in and for the City of Clifton. Such additional compensation shall be paid notwithstanding the maximum salary or wages hereinabove provided for such office or employment and shall be paid at the same time and in the same manner as the salary or wages fixed pursuant to the provisions of this article.
B. 
For the purpose of this article, all periods of employment shall be deemed to have commenced on January 1 of the year of appointment or employment, unless the actual date of such appointment or employment took place on or after July 1, in which case said period of employment shall be deemed to have commenced on July 1 of the year of said appointment or employment.
C. 
An interruption of service resulting from any cause beyond the control of the officer or employee, such as military service or injury in the line of duty or illness, shall be considered as service for the City of Clifton for the purpose of determining the completion of said cumulative period of five years of service with the City.
D. 
In computing such period of cumulative service in and for the City of Clifton, credit shall be given for all prior full-time service by an officer or employee as an employee of the State of New Jersey, or any other political subdivision thereof, unless the same is waived in writing by such officer or employee.
E. 
The terms and conditions of this section do not apply to members of the union employed after November 1, 1982.

A. 
Health insurance and prescription benefits.

(1) 
Health insurance. In addition to the compensation in the form of regular salaries and wages provided herein, the City of Clifton hereby grants and provides all employees hired prior to November 1, 1982, health insurance coverage in accordance with the terms and conditions of the applicable collective bargaining agreement and applicable New Jersey State statutes.
(2) 
Prescription benefits. All employees hired on or after November 1, 1982, shall receive the prescription plan benefit with concurrent copay in accordance with the applicable collective bargaining agreement, but no health insurance benefits shall be provided.
(3) 
Prescription opt-out bonus. Employees that receive the City's prescription coverage shall be eligible for an annual opt-out bonus of 25% of the net savings to the City on account of the waiver or $1,000, whichever is less, when they waive the City's prescription insurance coverage subject to the procedures and limitations set forth in the applicable collective bargaining agreement.
B. 
The City will continue to provide an eight-thousand-five-hundred-dollar life insurance policy for all crossing guards up to the age of 70. For employees age 70 and older, said insurance shall be in the amount of $2,500, and a one-thousand-dollar policy shall be provided to all retired employees for the first five years of retirement only.
C. 
Retirement benefits.

(1) 
Prescription insurance coverage, as set forth in Subsection A herein, is hereby extended to cover a period of a maximum of five years after retirement or until the employee's 65th birthday, whichever comes sooner. Health insurance for employees hired before November 1, 1982, shall continue in retirement as set forth in the applicable collective bargaining agreement.
(2) 
Any employee qualifying for the above prescription coverage who has exhausted his/her five years of retirement benefits will be eligible to pay the City the annual premium for such insurance coverage on an annual basis until such employee attains his/her 65th birthday or is otherwise not eligible for such coverage.
D. 
The City shall provide optional life insurance coverage for all employees. Said life insurance coverage shall be provided at the option of each employee with 75% of the cost of the same being paid by the respective employee. Coverage under said life insurance protection shall be in accordance with the schedule of coverage provided under the existing group life insurance plan maintained by the City.
E. 
The City may, at its option, change any of its insurance plans or carriers so long as substantially similar coverage is provided.

F. 
Effective January 1, 2022, all employees hired on or after January 1, 2021, shall be entitled to the City's prescription plan after 90 days of employment with the City.

G. 
The health insurance benefits provided pursuant to the terms of this article do not apply to members of the union who began their employment on or after November 1, 1982, except as noted herein. However, such employees are eligible for hospitalization coverage, provided that they agree to pay the costs for such coverage.

A. 
In addition to the compensation herein provided for as regular salaries and wages, the City of Clifton hereby grants and provides that the crossing guards shall earn sick leave at the following rate: eight days per year. All sick leave days, effective January 1, 1989, shall be cumulative for all employees.
B. 
Accumulated sick leave shall be governed by the terms and conditions set forth in the collective bargaining agreement and shall be subject to the caps and restrictions set forth by N.J. State statutes, including, but not limited to, N.J.S.A. l lA:6-19.1 and 11A:6-19.2, et seq.

A. 
All employees shall be entitled to vacation leave for the years 2004, 2005, 2006 and 2007 as follows:
(1) 
Employees hired prior to November 1, 1982, shall receive prorated vacation leave pursuant to Merit System Board law and the applicable rules and regulations promulgated thereunder.
(2) 
Employees hired on or after November 1, 1982 shall receive 10 days vacation leave.

B. 
All employees receiving vacation leave shall be permitted to take vacation leave only during the following periods of time:

Winter recess;
(2) 
Presidents' week;
(3) 
Spring break recess;
(4) 
July 1 through August 31; and/or
(5) 
N.J.E.A. convention recess.
C. 
A list of employees who will be at the parochial school(s) during Presidents' week recess will be provided to the City of Clifton each year by January 15.

A. 
All employees shall receive up to a maximum of four snow days as set forth under the terms and conditions of the applicable collective bargaining agreement.
B. 
All employees shall receive the following holidays: New Year's Day, Martin Luther King Day, Presidents' Day, Good Friday, Memorial Day, Thanksgiving Day and the day after Thanksgiving, Christmas Day and Juneteenth if school is closed for the holiday.

All employees covered by this article shall receive bereavement leave to a maximum of three days for those family members as defined in the collective bargaining agreement between the City of Clifton and the Clifton School Traffic Guards Union Local 1032, CWA.

The terms and conditions of the agreement between the City of Clifton and the Clifton School Traffic Guards Union Local 1032, CWA, are incorporated herein, and if any difference exists between this article and said agreement, the terms and conditions of the agreement shall control.
