This chapter shall be known as the "Galloway Equal Opportunity Ordinance."
The Affirmative Action Office is hereby retitled the "Equal Opportunity Office," and the Equal Opportunity Officer shall continue to perform the duties of the established Affirmative Action Officer, with an appropriate budget for those duties and for a variety of community interests and responsibilities hereinafter described in § 37-4 hereof. The Equal Opportunity Officer shall monitor the performance of township offices in the implementation of § 37-4.
A. 
The Equal Employment and Economic Opportunity Advisory Committee is hereby renamed the "Equal Opportunity Advisory Committee" and shall continue to perform the same duties as the established Advisory Committee as well as others described in § 37-4. Its function is to promote equal economic opportunities in the township, with an emphasis on local and minority participation in activities as otherwise provided in § 37-4. This committee shall be accorded equal status with other nonstatutory committees appointed by the Township Council.
B. 
The members of the Committee shall consist of 11 members and two alternates and shall be composed of two members from the Township Council and the others from the community at large, with one member having some background in construction and one having a disability or handicap. The members shall be nominated by the Advisory Committee and appointed by Township Council. The Advisory Committee shall establish its own rules of procedure.
C. 
The initial appointments shall be as follows: three members for terms of one year; three members for terms of two years; three members for terms of three years; Council representatives and alternates for terms of one year. All subsequent appointments shall be for terms of three years. Where an appointment is made to fill a vacancy, it shall be in all cases for the remaining unexpired term.
A. 
An Equal Opportunity Action Plan shall be prepared by the Advisory Committee and recommended to Township Council within six months of the appointment of members to the Committee by the Council. The Council shall adopt an Equal Opportunity Action Plan by resolution after receiving the Advisory Committee's recommendations. Said plan shall be updated, as may be required, with a mandated review by the Advisory Committee and the Township Council every three years.
B. 
The Action Plan shall be designed to promote community-wide, harmonious relations among all people and groups throughout Galloway without regard to color, race, religion, gender, national origin, ethnic background or physical or mental disability. This shall be implemented in a spirit of good will, tolerance and acceptance of diversity within the community. Towards that end, when it deems it appropriate, the Advisory Committee may offer its services as an informal conflict resolution agency when and if problems arise within the community for which conciliation or mediation may be useful, either upon referral from any local government or other community agency within the township, or upon its own initiative.
C. 
The Advisory Committee shall also address equal employment and economic opportunity matters relating to the township government, with the objective of assuring nondiscriminatory practices and of encouraging diversity and minority participation in township employment and award of township government contracts pursuant to the applicable statutes, but without specific quotas or set-asides.
The Equal Opportunity Office shall be notified of all employment and appointment vacancies, requests for bids, and solicitations for goods and services as well as construction by the township municipal government, with the intent of its involvement in the entire process including the final appointment, award or determination. Notification to the Equal Opportunity Officer shall be in concert with communication and feedback with all departments and/or functioning bodies of the township involved in the process.
It shall be the township's policy to encourage businesses which are newly developing or less established, including those owned by women and other minorities to submit quotes, proposals or bids for the township's construction projects. Sufficient information regarding substance and process shall be provided early enough before submission deadlines so as to enable such businesses to compete on an equal basis. No set-asides are to be employed in awards, but the township seeks to reach a goal of 15% participation by such businesses.
It shall be the township's policy to encourage vendors who are newly developing or less established, including those owned by women and other minorities, to submit quotes, proposals or bids for township goods, services or supplies. Sufficient information regarding substance and process shall be provided early enough before submission deadlines so as to enable such vendors to compete on an equal basis. No set-asides are to be employed in awards of bids, but the township seeks to reach a goal of 15% participation in the aggregate annual dollar total of such township purchases.
No quotas shall be employed in the township's hiring or promotional practices, but underrepresented residents of the township shall be given equal consideration with respect to employing municipal paid staff and appointments to positions, boards and committees by Township Council and management. Such underrepresented residents shall be actively recruited by the Equal Opportunity Office.
Except for the provisions of § 37-3 hereof, the present Equal Employment and Economic Opportunity Ordinance shall remain in effect until action pursuant to § 37-4 hereof has been completed.
