For the purposes of this chapter, the terms used herein are defined as follows:
Any and all premises upon which is conducted one or any combination of the following practices when done upon the scalp, face or neck for cosmetic purposes and not for the treatment of disease or physical or mental ailments, and when done for payment either directly or indirectly or without payment for the public generally: shaving or trimming the beard or cutting the hair; giving facial and scalp massage or treatment with oils, creams, lotions or other preparations, either by hand or mechanical appliances; singeing, shampooing or dyeing the hair or applying hair tonics; applying cosmetic preparations, antiseptics, powders, oils, clays or lotions to scalp, face or neck. The term "barbershop" shall not include beauty shops limited to the practice of hair and beauty culture and catering to female persons and as further defined in N.J.R.S. 45:4A-5.
