As used in this Article, the following terms
shall have the meanings indicated:
WATER SYSTEM
Any fire hydrant, gate valve or appurtenance belonging to
or forming part of the publicly owned water distribution system which
is operated by Passaic Valley Water Commission, pursuant to the provisions
of N.J.S.A. 40:62-108 et seq.
This Article shall not be construed to apply
to any duly authorized employee of the city who shall:
A. Open or operate any fire hydrant, gate valve or other
appurtenance of the water system or remove any part of the water system.
B. Have in his possession or on his person any hydrant
or hydrant part belonging to Passaic Valley Water Commission.
C. Turn on, turn off, attach any pipe or hose to or connect
anything with any fire hydrant, gate valve or other appurtenance of
the water system.
D. Remove any part or parts of the fire hydrant, gate
valve or other appurtenance of the water system in the performance
of his duties as such employee.
Any person who violates any provision of this
Article shall, upon conviction thereof, be punished by a fine not
exceeding one thousand dollars ($1,000.), by imprisonment for a term
not exceeding ninety (90) days or by a period of community service
for not more than ninety (90) days, or any combination thereof. A
separate offense shall be deemed committed on each day during or on
which a violation occurs or continues.
