As used in this chapter, the following terms shall have the meanings indicated:
ACCESS AND DEPARTURE ROUTES
All streets or highways used as the primary means of approaching or leaving the location of a mass gathering.
ADEQUATE
When used in the rules and regulations means "adequate" in the opinion of the Supervisors.
ALCOHOLIC BEVERAGES
As defined by the Pennsylvania Liquor Code, Act of 1951, P.L. 90, as amended.[1]
AMBULANCE
A vehicle which contains the equipment as specified by the American College of Surgeons and which is capable of two-way communications.
APPROVED
When used in the rules and regulations means "approved" in the opinion of the Department.
AUTHORIZED EMERGENCY VEHICLES
Emergency vehicles of municipal departments or public service corporations as are designated or authorized by proper local authorities; police vehicles; vehicles of the Fire Department and ambulance.
COUNTY
The County of Northampton.
DEPARTMENT
The Pennsylvania Department of Environmental Protection.
FIRST-AID TENT
Specifications of the first-aid tent to be set forth by the Forks Township Emergency Squad.
LAW ENFORCEMENT AGENCY
Any agency having authority granted by statute or ordinance to enforce the laws of the Commonwealth of Pennsylvania, or of the County of Northampton or of the Township of Forks.
LICENSE
Document and statement of conditions, issued by the Supervisors, under which an outdoor amusement is authorized.
LOCAL AUTHORITY
The Board of Supervisors of the Township of Forks.
MAXIMUM ESTIMATED ATTENDANCE
The estimated maximum number of persons that will be entering the outdoor amusement site.
OFFENSE
A violation of any provision of this chapter, or of any statute of this state.
OUTDOOR AMUSEMENT
Shall mean and include any outdoor assembly of people gathered for purposes of public entertainment, amusement or recreation with maximum estimated attendance of more than 500 persons. The term "outdoor amusement" does not include or apply to the regular continuing operations of a for-profit amusement park.
PARTICIPANTS
Individuals taking part in or attending the outdoor amusement.
PEACE OFFICER
Any person who by virtue of his office or public employment is vested by law with a duty to maintain public order or to make arrests for offenses, whether that duty extends to all offenses or is limited to specific offenses.
PERMANENT STRUCTURE
A building with a design life of greater than five years and supported by a foundation extending into the earth's surface below the frost line.
PLUMBING
The practice, materials and fixtures used in the installation, maintenance, extension and alteration of all piping, fixtures, appliances and appurtenances in connection with any of the following: sanitary drainage or storm drainage facilities, the venting system and the public or private supply system, within or adjacent to any building, structure or conveyance; also the practice and materials used in the installations, maintenance, extension or alteration of stormwater, liquid waste, or sewerage, and water supply systems of any premises to their connection with any point of public disposal or other acceptable terminal.
PRIVATE POLICE AGENCY
Any person, firm or corporation engaged in private police business who employs one or more persons conducting such business.
PRIVATE POLICEMAN
Any person conducting business, for hire or reward, as a guard, watchman, patrolman or other person, to protect persons or property, both real and personal, or to prevent the theft or unlawful taking of goods, wares or merchandise.
PRIVATE ROAD OR DRIVEWAY
Every way or place of private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
PROMOTER
Any person or persons, partnership, association or corporation, their officers, agents and employees, who, for themselves or others (by securing or furnishing capital or otherwise) take the preliminary or subsequent steps to organize, forward, encourage or advance through their skill, knowledge or organizational expertise, a plan or venture which constitutes an outdoor amusement as defined herein.
ROADWAY
That portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder.
SOLID WASTE
Any garbage, refuse or other discarded solid materials.
SUPERVISORS
The Board of Supervisors of Forks Township, Northampton County, Pennsylvania.
TOWNSHIP
The Township of Forks.
TRAFFIC
Pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances, either singly or together, while using any highway for purpose of travel.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway.
