No person shall conduct or cause to be conducted any outdoor assemblage which is attended by more than 30 persons without first obtaining a permit issued therefor by the Town Clerk pursuant to §
4-18 of this article.
No permit to conduct or cause to be conducted
any outdoor assemblage shall be required for the following activities:
A. Assemblages permitted pursuant to the provisions of Articles
I and
II of this chapter.
B. Private picnics and parties.
C. Peaceable assemblages to petition the government.
Any outdoor assemblage subject to the requirements for the issuance of a permit pursuant to §
4-15 of this article shall not be conducted beyond 12:00 midnight and shall be on premises equipped with or within reasonable access to sanitation facilities adequate for the number of persons in attendance. Notwithstanding the foregoing, the Town Board may extend the 12:00 midnight restriction upon written application therefor by the applicant, and the Town Board shall so notify the Town Clerk of such extension of time in writing.
An applicant for a permit to conduct an outdoor
assemblage shall file with the Town Clerk a verified petition setting
forth the name and address of the true owner of the premises upon
which the proposed outdoor assemblage is to be held, the location
of such premises, the nature and interest of the applicant therein,
with a map attached thereto showing the premises and location thereon
of the proposed outdoor assemblage, the location of sanitation facilities
thereon and the anticipated number of persons to be in attendance.
Upon the filing of a proper application as prescribed in §
4-18 of this article, the Town Clerk shall issue a permit to conduct an outdoor assemblage based upon the favorable consideration of factors relative to the health, safety and welfare of the general public.
The Town Clerk may revoke any permit issued
for the conduct of an outdoor assemblage where the health or safety
of the general public is impaired by the conduct of such outdoor assemblage.

Any person, firm, corporation or other entity who conducts or
takes part in any outdoor assemblage for which a permit is required
without first obtaining such permit shall be guilty of a misdemeanor
punishable by a fine not to exceed $500 or by imprisonment for not
less than 15 days nor more than 90 days, or by both.
