This article shall be known as the "Town of Brookhaven Office of the Supervisor Law."

A. 
Word usage. Whenever used in this article, words used in the singular include the plural and vice versa.
B. 
Definitions. As used in this article, the following terms shall have the meanings indicated:
DEPARTMENT
The Town of Brookhaven Office of the Supervisor.
DEPUTY SUPERVISORS
The Deputy Supervisors of the Town of Brookhaven Office of the Supervisor, one of whom shall act generally for and in place of the Supervisor.
SUPERVISOR
The elected public official who shall be chief executive and administrative officer of the Town of Brookhaven.
TOWN BOARD
The Supervisor and Councilmen.
A. 
There shall be in the Town of Brookhaven an Office of the Supervisor. The principal executive officer and administrative head of such office shall be the Supervisor, who shall be an elected official. The Supervisor shall be the head of the Office, with the power and authority to appoint and remove officers and employees under the Supervisor's jurisdiction in accordance with the Civil Service Law and other applicable laws.

B. 
The Supervisor is empowered herein to appoint a Deputy, who shall generally act for and in the Supervisor's behalf and who shall perform such duties as are vested in and imposed upon that office by the provisions of this article, by statute or by other lawful authority.
C. 
Before entering upon the duties of the Supervisor's Office, the Supervisor and Deputy Supervisor shall execute and file with the Town Clerk an official undertaking, if the same is required by the Town Board, in such sum as prescribed by the Town Board and in such form as approved by the Town Attorney.
D. 
Term of office and term limits.

(1) 
The Supervisor's term of office, as elected by a majority of Town of Brookhaven voters, shall be for four years until the next required election date.
(2) 
The Supervisor may serve up to three four-year terms regardless of whether said terms are served consecutively or nonconsecutively.

A. 
The Supervisor shall have such powers as shall be necessary for the proper administration of the Office consistent with applicable provisions of law.
B. 
General powers and duties.
(1) 
Community relations. The Supervisor's powers and duties are to administer, manage and provide a more effective Town emphasis on improvement of services to the citizens, to act as an ombudsman in Town government for residents of the Town and to research and recommend new and improved programs or services which focus on improving suburban lifestyle.
(2) 
Budget preparation and management. The Supervisor shall, on the basis of estimates submitted to the Supervisor by departments, agencies and officers of the Town, prepare annually the preliminary budget of the Town and submit it to the Town Council and shall be responsible for administration of the annual budget after adoption by the Town Council and shall be responsible for recommending modifications and transfers between appropriations in such budget during the fiscal year. The Supervisor shall, in addition, prepare a proposed capital budget on the basis of estimates submitted to the Supervisor by departments, agencies and officers of the Town and shall recommend for action by the Town Council, from time to time, when necessary, modifications and transfers between appropriations in such capital budget. The Supervisor may appoint a Budget Officer, who shall serve at the pleasure of the Supervisor at such salary as the Town Board may from time to time fix, to assist in the discharge of this duty.

(4) 
Administration. As chief administrator of the Town of Brookhaven, the Supervisor shall manage the affairs of the Town with regard to organizational problems, personnel, labor relations and all other matters related to the administration of Town government.
(5) 
The Public Information Office is hereby established under the Office of the Supervisor. This Office shall provide residents with Town information through the use of media, newsletters, publications and the website. This Division will also assume significant responsibility for content on the Town's public access television channel. The Division will be the primary source of information for residents during a national disaster or Town emergency.
(6) 
Operation. The Supervisor shall appoint members of the Town Board as liaison with the various officials, departments, divisions, bureaus and committees of the Town of Brookhaven.
(7) 
Legislative. The Supervisor shall be responsible for enactment, administration and enforcement of legislation. The Office of the Supervisor shall coordinate requests from various Town departments, divisions, bureaus, committees and officials for particular legislation.
(8) 
Intergovernmental relations. The Supervisor shall coordinate projects and other cooperative ventures with other local and state municipalities and with the federal government.
(9) 
Special districts. All costs and expenses incurred by the Department or its officers or employees on behalf of a special improvement district or special Town project shall be charged against such district or project and paid for from the funds duly appropriated for the purpose of such district or project.
(10) 
The division of personnel. This Division shall be responsible for the implementation of functions related to employment and staffing, civil service reporting and coordination, labor relations, benefits, assorted employee programs and services and payroll loading and finance coordination.

(12) 
The division of the office of management and budget. This Division is responsible for advising the Supervisor on budget matters; 451-TOWN, the Town of Brookhaven Constituent Response Center; Service Stat, a data-driven management system; constituent services; and budget analysis.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in § 29, 52 and 125 of the Town Law of the State of New York or any statutory or other powers which may be lawfully exercised by said Supervisor.

If any section, provision or part thereof in this article shall be adjudged invalid or unconstitutional by a court of competent jurisdiction such adjudication shall not affect the validity of the article as a whole or any section, provision or part hereof not as adjudged invalid or unconstitutional.
