No person shall detain or fail to return any book, periodical, recording on CD, video recording (DVD), video game and associated materials, portable electronic device, or any other article borrowed from the Free Public Library of the Borough of Upper Saddle River after 30 days have elapsed from the date of posting by certified mail, return receipt requested, of a notice demanding return thereof and notification of suspension of borrowing privileges, addressed to said person at the last address furnished.
No person shall cut, tear, deface, disfigure, damage, destroy or otherwise alter any book, periodical, recording on CD, video recording, video game and associated materials, portable electronic device, or other article, or any part thereof, which is borrowed from, owned by, or is in the custody of such library.
No person shall remove any book, periodical, recording on CD, video recording, video game and associated materials, portable electronic device, or other item or article from the Free Public Library building without complying with the rules, regulations and procedures of the library for borrowing such items or articles.
The Library Director is authorized to file a complaint in the Municipal Court under the following conditions:
A. 
A certified letter, return receipt requested, shall be sent by the library administration 30 days following the certified mailing of the demand for return of materials and suspension of borrowing privileges informing the person that the book or material is overdue and that he is subject to prosecution pursuant to this chapter.
B. 
In the case of a minor, the letter shall be sent to the parents of the minor involved.
C. 
In the case of an employee, the letter shall be sent to the authorizing employer of the individual named.
D. 
The book, material or article shall be overdue for at least three months and the individual's borrowing privileges shall be suspended.
No person with intent to defraud shall register or furnish a false name or address, or use any card other than the one issued to said person for the purpose of borrowing any book or other article, or accessing or downloading proprietary electronic resources, from such library or branch.
For violation of any provision of this chapter, the maximum fine shall be in accordance with § 1-15 of this Code. In addition, in determining the fine and penalty, consideration shall be given to the full replaced cost of the material, including processing and acquisition costs, as well as full reimbursement to the library for all costs associated with the filing of the complaint, including, but not limited to, administrative costs, mailing fees and court costs incurred.
