This chapter shall be known and may be cited as "Local Law No. 2 of
the Year 2002, Changing the Terms of Office of the Members of the Town of
Clarkson Zoning Board of Appeals."
The Town Board of the Town of Clarkson, through the power granted to
it under the appropriate provisions of the Town Law, has created a Zoning
Board of Appeals and has appointed members to said Board. The Zoning Board
of Appeals consists of five members. The Zoning Board of Appeals has been
given certain powers under §§ 267-a and 267-b of the New York
State Town Law to consider area variances and use variances and issue interpretations
together with other duties set forth in the Code of the Town of Clarkson such
as granting special permits. In order to provide the people of the Town of
Clarkson a more frequent opportunity to serve on such an important Board in
the Town of Clarkson, which Board affects the lives and property of many residents,
the Town Board has determined to exercise the authority given to it under
the laws of the State of New York to amend the Town Law to reduce the duration
of the terms during which a Zoning Board of Appeals member holds office. It
is the intent of this chapter to supersede the provisions of § 267(4)
and (5)of the New York State Town Law.
As used in this chapter, the following terms shall have the meanings
indicated:
MEMBER OF THE ZONING BOARD OF APPEALS
A person appointed to the Zoning Board of Appeals of the Town of
Clarkson by the Town Board of the Town of Clarkson, pursuant to the authority
granted the Town Board under § 267 of the Town Law.
TERM OF OFFICE
The period of time a member of the Zoning Board of Appeals appointed
by the Town Board shall hold office.
Any person appointed as a member of the Zoning Board of Appeals by the
Town Board of the Town of Clarkson after the effective date of this chapter
shall serve for a term ending on the third December 31 from the date of appointment.
If a vacancy shall occur other than by expiration of term, it shall be filled
by the Town Board by appointment for the unexpired term.
The current term of any person heretofore appointed to the Zoning Board
of Appeals shall not be changed by this chapter, but if such person ceases
to serve on said Board the replacement term shall be as provided herein. Upon
expiration of the current term of any person heretofore appointed, such new
term for such person or another person appointed shall be as provided herein.
