This article applies to the administration and enforcement of the Plumbing Standards of the New York State Building Construction Code.

Editor's Note: On 10-16-1972, the Council of the City of Schenectady adopted Res. No. 10361 which read as follows: "It is not the intent of the Building Construction Code applicable to plumbing to limit or exclude the use of any material or system of plumbing installation which has been produced or developed under nationally recognized standards and certified by a recognized standards or testing agency, provided that the use of such material or system complies with such standards and is in accord with such standards and is in accord with acceptable health and safety criteria."

All plumbing work in the City and all plumbing work where the real property is situated outside the City and will obtain its water supply from water furnished by the City or the sewage from said property will eventually be discharged through the sewerage system of the City shall come under the provisions of this chapter, except the Town of Niskayuna where inspection is made only where town mains are directly connected to City sewer or water mains.
A. 
The Plumbing Inspector shall be a practical plumber and shall not be engaged, directly or indirectly, in the business of plumbing during the period of his appointment. He shall be a citizen and an actual resident of the City, and before entering upon the discharge of his duties as such inspector, he shall be required to obtain a certificate of competency from the Examining Board. The Plumbing Inspector shall be appointed by the Mayor. He shall report to and be accountable to the Building Inspector.

B. 
Except as otherwise specifically provided by law, ordinance or regulation or except as herein otherwise provided, the Plumbing Inspector shall administer and enforce all of the provisions of laws, ordinances and regulations applicable to all plumbing and drainage work in the City and all plumbing work where the real property is situated outside the City and will obtain its water supply from water furnished by the City of Schenectady or the sewage from said property will eventually be discharged through the sewerage system of the City.
C. 
He shall issue all permits for plumbing or drainage and certificates of approval and charge the fees as provided in this chapter.
D. 
He may revoke a permit or certificate of approval if there is a violation of any provision of this chapter or any false statement or misrepresentation in the application, plans or specifications.
E. 
He shall inspect the construction and alteration of all plumbing work performed in the City and all plumbing work performed outside the City which is connected with the City water supply or the City sewerage system, except the Town of Niskayuna where inspection is made only where the town mains are directly connected to City sewer or water mains. No connections shall be made to water mains supplied with water from the City or sewers which connect with or are part of the new sewerage system of the City until approval of the plumbing work by the Plumbing Inspector after final inspection. Application for final inspection must be made by the plumber or permit holder within 10 days after the plumbing work has been completed.

F. 
He shall issue all appropriate notices or orders to correct unsanitary or defective conditions, to remove illegal or unsafe conditions, to require the necessary safeguards during construction and to ensure compliance during the entire course of construction with the requirements of such laws, ordinances or regulations.
The Plumbing Inspector shall keep permanent official records of all transactions and activities conducted by him, including all applications received, permits and certificates issued, fees charged and collected and inspection reports and notices and orders issued. All such records shall be public records open to public inspection during business hours.
Wherever the Building Inspector is required to issue a permit for any building construction or for the alteration, repair or replacement of any building, or parts thereof, the Building Inspector or his duly appointed subordinate shall see that plumbing and drainage details are set forth on all plans and specifications to be submitted to the Building Inspector prior to the issuance of the building permit. For all work which requires a building permit, the fees as set forth in Article I shall be paid by the building contractor or owner before the plumbing permit is issued by the Plumbing Inspector.

The City Engineer and the Director of Water and Wastewater shall not issue a permit to anyone to connect with the sewers or with the water mains unless such person has obtained and shall produce a certificate of competency from the Examining Board of Plumbers.
