A person affected by an order or decision of the Code Official which
has been made in connection with the enforcement of this code may request
and may be granted a hearing on the matter before the County Commissioners.
A written petition requesting the hearing must be received by the Clerk to
the County Commissioners within 30 days after service of notice of the order
or decision. Within 10 days of receipt of the petition, the Code Official
shall notify the petitioner, in writing, of the date, time and place of the
hearing.
The County Commissioners shall hold a hearing and issue their decision
on the appeal within 60 days after receipt of the petition by the Clerk.
The filing of an appeal petition shall stay the effect of the order
or decision being appealed. If, following the hearing, the County Commissioners
uphold the order or decision of the Code Official, then any deadline for compliance
shall stand as previously imposed and shall be measured from the date of the
decision of the County Commissioners on the appeal petition.
Within 20 days after the decision by the County Commissioners on an
appeal, a person affected by an order or decision of the Code Official may
appeal to a court of competent jurisdiction. Written notice to the County
Commissioners shall be provided at the time of the filing of an appeal.
