A. 
Word usage. The following rules shall apply to this chapter:
(1) 
The particular shall control the general.
(2) 
The word "shall" is mandatory.
(3) 
Words used in the present tense shall include the future; words used in the singular number include the plural; and words in the plural number include the singular.
(4) 
The word "building" or "structure" includes the other and any part thereof.
(5) 
The word "person" includes an individual, a corporation, a partnership, an incorporated association or any other similar entity.
(6) 
Unless the context clearly indicates the contrary, where a regulation involves two or more items, conditions, provisions or events connected by the conjunction "and," "or" or "either .... or," the conjunction shall be interpreted as follows:
(a) 
"And" indicates that all the connected items, conditions, provisions or events shall apply.
(b) 
"Or" indicates that the connected items, conditions, provisions or events may apply separately or in any combination.
(c) 
"Either .... or" indicates that the connected items, conditions, provisions or events shall apply separately but not in combination.
(7) 
The word "includes" shall not limit a term to the specified examples but is intended to extend its meaning to all other instances or circumstances of like kind or character.
(8) 
All terms defined in the Caroline County Zoning Ordinance[1] shall have the same meanings in this chapter unless specifically defined in this chapter.

(9) 
Words and terms not defined herein shall be interpreted in accordance with their normal dictionary meanings.
B. 
Definition of terms. As used in this chapter, the following terms shall be defined as follows:
BLOCK
An area of land containing one or more lots and bounded by streets providing access to such lot or lots.
BUILDING DEVELOPMENT
The improvement of land by the addition thereto of structures for residential, commercial or industrial uses.
BUILDING RESTRICTION LINE
A line determined by the minimum front, side and rear yard requirements of the Zoning Ordinance[2] for the district in which the lot is located, beyond which the foundation walls, enclosed porch, vestibule or other enclosed portion of a building or structure shall not project.
CLOSED SECTION CONSTRUCTION
A road whose pavement is bounded by a raised curb and where runoff is channeled along the face of the curb to a storm drain or other outlet in accordance with the typical sections contained in the Caroline County Design Standards and Specifications.
CLUSTER DEVELOPMENT
A subdivision using varying lot sizes to group houses while maintaining the same density as a conventional subdivision within a specific zoning district.
COMMUNITY SEWERAGE FACILITIES
Any system, whether publicly or privately owned, serving two or more individual lots for the collection and disposal of sewage or industrial wastes of a liquid nature, including various devices for the treatment of such sewage and industrial wastes.
COMMUNITY WATER SUPPLY FACILITIES
A source of water and a distribution system, including treatment and storage facilities, whether publicly or privately owned, serving two or more individual lots.
COMPREHENSIVE PLAN
A document consisting of written and mapped information adopted by the County Commissioners and intended to guide the physical development of Caroline County, including all changes and additions thereto made under the provisions of Article 66B of the Annotated Code of Maryland, and known as the "Comprehensive Plan of Caroline County, Maryland."
COUNTY
Caroline County, Maryland.
COUNTY COMMISSIONERS
The County Commissioners of Caroline County, Maryland.
COUNTY ENGINEER
The person designated by the County Commissioners to carry out engineering duties as specified in this chapter.
COUNTY HEALTH OFFICER
The Deputy State Health Officer for Caroline County or his duly authorized representative.
COUNTY PLANNER
The person designated by the County Commissioners to be the chief executive officer of the Planning Department, to serve as an advisor to the Planning Commission and to carry out duties as specified in this chapter.
COUNTY ROAD
A road for which the easement for use or title is vested with the County Commissioners by grant, condemnation or dedication and for which the County Commissioners or Roads Board has accepted maintenance responsibility.
DEVELOPER
See "subdivider."
DOUBLE-FRONTAGE LOT
A lot extending through the block from one road to another.
EASEMENT
A strip of land for which a limited right has been granted for one or more specific purposes, but not including fee-simple title to the land.
ENTRANCE PIPE
A drainage pipe or culvert placed in a roadside drainage ditch parallel to the road for the purpose of allowing access to a lot without disrupting drainage flow.
FLOODPLAIN
Any land area susceptible to being inundated by water from any source. (See "flood" or "flooding.")

ONE-HUNDRED-YEAR FLOOD
A flood that has one chance in 100 or a one-percent chance of being equaled or exceeded in any given year.

OPEN SECTION CONSTRUCTION
A road where the pavement is bounded by a sloped shoulder and where runoff is directed to an open ditch paralleling the pavement surface in accordance with the typical sections contained in the Caroline County Design Standards and Specifications.
ORIGINAL LOT OR PARCEL
A lot, tract or parcel of land existing by deed or plat description in the land records of Caroline County on November 30, 1972.
OWNER
The person, partnership, corporation, company or other legal entity holding current legal title to a lot, tract or parcel of land.
PANHANDLE LOT
A polygonal-shaped lot with the appearance of a frying pan or flag with staff in which the handle is used as the point of access to a road. "Panhandle lots," also known as "flag lots" or "pipestem lots," are frequently used to allow access to interior lots without the construction of public roads.
PAVED ROAD
A road covered with either a rigid or flexible pavement, such as bituminous surface treatment, asphalt concrete or portland cement concrete.
PLANNING COMMISSION
The Caroline County Planning Commission.
PLATS
(1) 
SKETCH PLATA sketch indicating the subdivider's general objectives and desires in regard to the future development of his land.
(2) 
PRELIMINARY PLATThe preliminary drawings and supplementary material indicating the proposed layout of the subdivision to be submitted to the Planning Commission for its consideration.
(3) 
FINAL PLATThe final map, drawing or chart upon which the subdivider's plan of the subdivision is presented to the Planning Commission for approval and which, if approved, will be submitted and recorded with the Clerk of the Circuit Court of Caroline County.
(4) 
MINOR SUBDIVISION PLATThe final drawing, for subdivisions from one to four lots, upon which the subdivider's plat of subdivision is presented to the Zoning Administrator for approval and which, if approved, will be recorded with the Clerk of the Circuit Court of Caroline County.
REGULATED FLOODPLAIN
A floodplain regulated by Chapter 108 of this Code, or by other statutory or regulatory provision.

RESERVATION
The assignment of land by a subdivider for a specified use, to be held by him for that use and no other to a future time.
RESUBDIVISION
A further division or modification of an existing subdivision properly recorded in the land records of Caroline County after November 30, 1972.
RIGHT-OF-WAY
A strip of land designated for the use of a street, highway, driveway, alley or walkway or for any drainage or public utility purpose or other similar use.
ROAD
A way for vehicular traffic which provides primary access to abutting properties. "Roads" may be classified as follows:
(1) 
MAJOR ARTERIAL ROADSRoads intended to carry large volumes with average daily traffic of 1,000 or more vehicles per day.
(2) 
ARTERIAL ROADSSegments of the County roads system which carry moderate traffic and act as feeders to state highways or major arterial roads and all roads in subdivisions which provide access or may in the future provide access to 50 or more lots.
(3) 
COLLECTOR ROADSSegments of the County roads system which carry light traffic, are nonconducive to through traffic and serve primarily local traffic and all roads in subdivisions which provide access or in the future may provide access to less than 50 lots.
(4) 
CUL-DE-SAC ROADSShort roads having but one end open for vehicular traffic, the other being permanently terminated by a turnaround for vehicles.
ROADS BOARD
The County Roads Board for Caroline County.
SIDEWALK
A paved walk for pedestrian traffic only, placed generally parallel to a road and within the road right-of-way.
STREET
See "road."
SUBDIVIDER
An individual, partnership or corporation, or agent thereof, that undertakes the responsibility for any or all of the activities covered by this chapter, particularly the design and submission of a subdivision or development plan or plat showing the layout of the land and the public improvement involved therein. Inasmuch as the subdivision plat is a necessary means to the end of assuring a satisfactory development, the term "subdivider" is intended to include the term "developer," even though the personnel or entity involved in successive stages of the project may vary.
SUBDIVISION
The division of a lot, tract or parcel of land into two or more lots, plats, sites or other divisions of land for the purpose, whether immediate or future, of transfer of ownership or of building development. "Subdivision" includes resubdivision and, when appropriate to the context, shall refer to the process of subdividing or the land subdivided. "Subdivisions" shall be classified into one of the following:
(1) 
MAJOR SUBDIVISIONAny subdivision containing five or more lots, plats, sites or other divisions of land.
(2) 
MINOR SUBDIVISIONAny subdivision containing four or fewer lots, plats, sites or other divisions of land.
(3) 
RURAL MAJOR SUBDIVISIONA subdivision, located in the R, Rural District, containing five or more but not more than 25 lots, plats, sites or other divisions of land. A "rural major subdivision" may contain minor subdivision lots, lots allowed by the overall gross density standard, or lots from an approved transfer of subdivision development rights, or any combination thereof up to the maximum size of 25 lots. Requirements for a "rural major subdivision" shall be the same as for a major subdivision unless specifically indicated otherwise.

TECHNICAL ADVISORY COMMITTEE
A Committee organized to review and comment on subdivision and other development proposals, consisting of the following persons or their designated representatives: the Zoning Administrator, County Planner, County Engineer, Superintendent of County Road Operations, State Highway Administration Maintenance Engineer, Director of Environmental Health Services, Soil Conservation Service District Conservationist and representatives of other agencies concerned with development or subdivision review.
UNPAVED ROAD
A road lacking a rigid or flexible pavement such as found on a paved road and generally surfaced with dirt, sand, shell or gravel.
WALKWAY
As distinguished from a sidewalk which is incorporated in a road right-of-way, a "walkway" is a pedestrian right-of-way usually extending from a street into a block or across a block to another street.
ZONING ADMINISTRATOR
The person designated by the County Commissioners to administer and enforce the provisions of this chapter and the Zoning Ordinance[3] and to carry out the duties as specified in this chapter.
