GENERAL REFERENCES
Peddlers, canvassers and solicitors — See Ch. 168.
As used in this chapter, the following terms shall have the meanings indicated:
LITERATURE
Any newspaper, magazine, handbill, pamphlet, circular, dodger or any other piece of commercial paper or otherwise, not including mail.
OBJECTOR
Any adult person and any firm, partnership, association, corporation, company or organization of any kind who or which is a resident of the Township of Colts Neck and who or which objects to the depositing of literature, other than mail, on his, her or its property in accordance with the procedures set forth in this chapter.
UNIMPROVED PROPERTY
Any and all lots, plots and parcels of land containing no habitable structure or business use.
A. 
Any resident or owner who objects to receiving unsolicited literature, other than mail, may, in writing, so notify the Township Clerk. Such notice shall be signed by the objector and shall reasonably identify the property to which it applies. The Township Clerk shall keep said notices on file in the township offices and shall deliver a copy or list of the same to the State Police located within the Township of Colts Neck.
B. 
The form of the aforesaid notice may be substantially as follows: "The undersigned, being the (owner/resident) of (street address) in the Township of Colts Neck, hereby objects to the placement of unsolicited literature, other than mail, on the aforesaid premises."
C. 
Each such notice shall be effective upon receipt by the Township Clerk and shall remain effective until the Township Clerk receives written notice from the objector that the objection is to be removed or the objector moves from the Township of Colts Neck. Upon receipt of such removal notice or change of address of the objector, the Township Clerk shall appropriately amend the file and shall so notify the State Police.
D. 
Any person desiring to place unsolicited literature on any private residential property in the Township of Colts Neck shall have access to the aforesaid files during regular business hours.
E. 
The aforesaid files shall constitute, insofar as any person desiring to place unsolicited literature on private residential property in the Township of Colts Neck is concerned, notice of objections thereto.
F. 
Nothing herein shall be construed to limit in any way the right of any person to solicit the consent of the objector to the receipt of any specific item of literature at any time or on a continuing basis.
The following actions shall be deemed to be violations of this chapter:
A. 
The distribution, casting, throwing or otherwise placing of any unsolicited literature, other than mail, on the property of any objector within the Township of Colts Neck.
B. 
The distribution, casting, throwing or otherwise placing of any unsolicited literature, other than mail, on any public place, paved or unpaved street or right-of-way within the Township of Colts Neck.
C. 
The distribution, casting, throwing or otherwise placing of any literature on any unimproved property within the Township of Colts Neck.
D. 
The directing, authorizing or permitting in the capacity of employer, supervisor or otherwise of any person to violate the provisions of this chapter.

A violation of any provision of this chapter shall be punishable as provided in § 1-9 of this Code.
