The Site Development Plan Rules and Regulations (SDPRR) are established herein pursuant to Article 7 of the Village Law of the State of New York and § 10 of the Municipal Home Rule Law. They supplement the requirements of Article IX of the Zoning Chapter and apply to all site development plans required to be submitted to the Village Planning Board for all buildings, structures and uses other than for one-family detached residences.
The rules and regulations are intended to assist the Village Planning Board in fulfilling the objectives set forth in § 195-46 of Article IX of the Zoning Chapter.
All site development plans shall comply with the application requirements and procedure as set forth in Article IX of the Zoning Chapter.

At the time of the public hearing on the final site development plan, the applicant shall submit an affidavit stating that the applicant has notified by first-class mail with certificate of mailing, property owners (as shown on the latest real property tax rolls) adjacent to or across the street from the site, at least 10 days prior to the public hearing, and that the applicant has completed and placed at least one poster for every 300 feet of road frontage of the property in a visible location; said poster shall be provided to the applicant by the Clerk to the Planning Board. The Village shall advertise the hearing in a newspaper of general circulation at least five days prior to the hearing. The notice to be mailed shall conform to the official form of notice set forth in Appendix A hereto.[1]

The Planning Board may require financial security for the purpose of securing, stabilizing and restoring a site, to preclude the potential for intrusion, erosion, or the creation of an attractive nuisance. The amount of such security shall be computed in accordance with the requirements of § 108-2A of the Montebello Code. Such security, if required, shall be in a form satisfactory to the Village Attorney. Such security shall run to the benefit of the Village of Montebello and shall include a provision that the principal of the security shall comply with all of the terms of the resolution of final plat approval as determined by the Planning Board and shall include, but not be limited to, the performance of all required on-site and off-site improvements, and that all improvements and land included in the irrevocable offer of dedication shall be dedicated to the Village of Montebello free and clear of all liens and encumbrances on said premises.
