This article shall be known and may be cited hereinafter as the "Trash
Pickup Law of the Village of Montebello."
A.
For the purposes of this article, the following terms,
phrases, words and their derivations shall have the meanings given herein.
When not inconsistent with the context, words used in the present tense shall
include the future, words in the plural number include the singular number,
and words in the singular number include the plural number. The word "shall"
is always mandatory and not merely directory.

VILLAGE
As used in this article, the following words shall have
the meanings indicated:
Any person, firm, partnership, association, corporation, company
or organization of any kind.
Discardable household items of a durable nature such as furniture, cardboard
cartons or packaging and household appliances, except for large appliances
such as refrigerators, washing machines, dryers, dishwashers and hot water
heaters.
Garden, yard and lawn waste such as clippings, leaves (only if placed
in containers), cartons or bags which are securely fastened; and Christmas
trees, tree branches and fallen trees cut into sections less than four feet
long.
Ashes and other refuse resulting from the burning of wood or coal in
a residence for heating purposes, so long as placed in containers, cartons
or bags.
Motor vehicle tires and parts, except for junk vehicles, vehicle bodies
or engine blocks.
Materials left over from home improvement and remodeling projects relating
to existing residences, such as lumber, paneling, rolled insulation, wiring,
pipes and plaster, concrete and bricks, only if the same are placed in containers
or cartons such as are specified later herein. Refuse from demolished, renovated
or newly constructed buildings shall not be considered as "trash." In order
to be considered "trash," the item or article itself should be, or in the
case of items or articles required to be placed in containers, cartons or
bags, the filled container, carton or bag must be capable of being picked
up by two men.
The Village of Montebello.
For collection pursuant to a schedule announced by the Village of Montebello,
all trash must be placed on the curbline where accessible. Such trash shall
be placed in containers whenever possible. Such trash shall be set out no
earlier than 3:00 p.m. on the day prior to collection, and all containers
shall be removed no later than 8:00 p.m. on the collection day. When a regular
collection day falls on a legal holiday, containers shall not be set out until
the next regularly scheduled collection day unless special announcement of
collection is made by the Village.
The Police Department serving the Village of Montebello and/or the enforcement
official shall have the power, right and authority to issue an appearance
ticket for the violations of this article.
B.
In the case of continuing violation of this article,
each day that such violation exists shall constitute a separate and distinct
Class 3 violation.
C.
The remedies contained within this article shall further
not be exclusive, but shall be in addition to any other remedy provided by
law, so long as not inconsistent herewith, nor shall the invoking of any remedy
or procedure contained within this article preclude the pursuit of any and
all other remedies, and the same are intended to be cumulative.
This article supersedes, and is in derogation of, Chapter 373 of the
Code of the Town of Ramapo, County of Rockland, State of New York. This article
is enacted by authority of § 20, Subdivision 5, of the Municipal
Home Rule Law and any other law referenced herein as authority herefor.
