These requirements shall be deemed the minimum
requirements for growth and development of the Village and for the
provision of adequate facilities for the housing, transportation,
comfort, convenience, safety, health and welfare of its population.
Where the Board finds that, because of the special
circumstances of a particular lot or tract sought to be subdivided,
extraordinary hardship, not created by the owners or subdividers,
may result from strict compliance with this chapter, it may, at the
direction of the Village Zoning Board of Appeals, waive any of these
regulations so that substantial justice may be done and the public
interest secured; provided, however, that such waiver shall not have
the effect of nullifying the intent or purpose of the Comprehensive
Plan, Official Map or this chapter. In granting any waiver, the Board
shall set forth its findings as to the reasons therefore in its resolution
of approval and shall impose such conditions as shall substantially
secure the objectives of the standards or requirements so waived or
modified.
In addition to all other remedies available
to the Village and/or the Planning Board, as set forth in applicable
statutes, ordinances or law, any person, firm or corporation which
shall violate or shall be found guilty of violating any of these regulations
shall be subject to a fine of $100 per day for each day during which
or during a portion of which such violation shall exist. In addition
thereto, no building permit or certificate of occupancy shall be issued
with respect to any lot, forming any part of any other lot or tract
to which this chapter shall be applicable on which such violation
or violations may exist.
