No person shall plant, remove, cut above ground
or otherwise disturb any tree on any street or municipal-owned property
without first filing an application and procuring a permit from the
City Engineer's office or other specified municipal authority.
An application for a permit required by the
provisions of this article shall be made at the office of the City
Engineer not less than 48 hours in advance of the time the work is
to be done. The application required herein shall state:
A. The number of trees to be set out;
B. The location, grade, species, cultivar or variety
of each tree;
C. The method of planting; and
D. Such other information as the City Engineer shall
find reasonably necessary to a fair determination of whether a permit
should be issued.
The City Engineer shall issue the permit provided
for herein if, in his judgment, the proposed work is desirable and
the proposed method and workmanship thereof are of a satisfactory
nature. Any permit granted shall contain a definite date of expiration
and the work shall be completed in the time allowed on the permit
and in the manner as therein described. The City Engineer shall have
the authority to affix reasonable conditions as to the granting of
a permit. A permit shall be void if any of its terms or conditions
are violated.
A person issued a permit pursuant to the provisions
of this article shall abide by the Arboricultural Specifications of
Practice adopted by the City Engineer.
The City Engineer shall supervise or inspect
all work done under a permit issued pursuant to this article.
A person performing work under a permit issued
pursuant to the provisions of this article shall give notice of completion
of such work to the City Engineer within five days of the same.
