The following list constitutes the species of trees for the Village of Pelham which may be planted on Village property lying between property lines on either side of all streets, avenues or ways within the Village. No species other than those included in this list may be planted without written permission of the Village Tree Committee.

The spacing of trees located on Village property lying between property lines on either side of all streets, avenues and ways within the Village shall be in accordance with the three species size classes listed in § 93-7 of this chapter, and no trees may be planted, without the written permission of the Village Tree Committee, closer together than the following; small trees, 30 feet; medium trees, 40 feet; and large trees, 50 feet.
The distance trees may be planted from curbs or curblines and sidewalks, without the written permission of the Village Tree Committee. shall be in accordance with the three species size classes listed in § 93-7 of this chapter, and no trees may be planted closer to any curb or sidewalk than the following; small trees, two feet; medium trees, three feet; and large trees, four feet. This § 93-9 shall not apply to Fifth Avenue, Wolf's Lane and Lincoln Avenue.
No trees other than those species listed as small trees in § 93-7 of this chapter may be planted over or within five lateral feet of any underground water line, sewer line, transmission line or other utility.
A. 
The Village shall have the right to plant, prune, maintain and remove trees, shrubs, bushes and all other woody vegetation on Village property or overhanging Village property, as may be necessary to ensure public safety or to preserve and enhance the symmetry and beauty of such Village property.
B. 
The Village Tree Committee may recommend to the Village Board of Trustees the removal of any tree or part thereof which is in an unsafe condition, or which, by reason of its nature, is injurious to sewers, electric power lines, gaslines, waterlines or other public improvements, or is affected by any injurious fungus, insect or other pest.
C. 
An adjacent property owner may plant trees on the Village property lying between the adjacent property owners property line and the street, avenue or way in front of such property, provided that the selection and location of said tree is in accordance with §§ 93-7 through 93-11 of this chapter.
It shall be unlawful for any person or firm, other than the Village or a Village contractor, to top any trees on public property. "Topping" is defined as a severe cutting back of limbs or stubs larger than three inches in diameter within the tree's crown to such a degree as to remove the normal canopy and disfigure the tree. Trees severely damaged by storms or other causes, or certain trees on the utility wires or other obstructions, where other pruning practices are impractical, may be exempted by this chapter by the Village Administrator.
A. 
Any owner of any tree overhanging any street or right-of-way within the Village shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be clear space of eight feet above the surface of the street or sidewalk.
B. 
Every owner of any hedges, bushes or other vegetation shall prune such vegetation so that there shall be a clear space of six lateral inches from any Village sidewalk.
C. 
Every owner shall remove all dead, diseased or dangerous trees or broken or decayed limbs which constitute a menace to the safety of the public.
A. 
The Village Tree Committee shall notify, in writing, the owners of any dead or diseased trees on private property within the Village when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the Village. The owner shall remove such trees at his own expense within 60 days after the date of service of notice.
B. 
In the event of the failure of the owner to comply with the provisions of this section, the Village shall have the authority to remove, or cause to be removed, such trees, and the expenses incurred by the Village shall be paid to the Village by the owner. The Village Administrator shall file among his records an affidavit stating, with fairness and accuracy, the items of expense and the date of execution of actions authorized by this section. Upon failure of the owner to pay such expenses, the Village Administrator may institute a suit in the name of the Village to recover such expenses against the owner, or may cause such expenses to be charged and assessed against the property as a lien. If such expenses are not paid within 10 days after demand, the amount (plus a penalty charge of 18% annually) thereof shall be added to and become a part of the taxes next to be assessed and levied upon said premises and shall be collected and enforced in the same manner as taxes.
