Borough of Sayre, PA Part 2 Sidewalk Openings for Tree Plantings

Article II Standards and Procedures

§ 141-8 Area in which trees may be planted.

Property owners on the following streets may apply to the Borough Manager for permission to plant trees in the sidewalk area and to remove a sidewalk square up to three feet square for the trees:

A. Desmond Street between Lockhart Street and Hayden Street.

B. Elmer Avenue between Lockhart Street and Hayden Street.

C. Packer Avenue between Lehigh Avenue and Elmer Avenue.

D. Lockhart Street between Lehigh Avenue and Elmer Avenue.

§ 141-9 Opening; type of tree.

The size and location of the opening and the type of tree shall be described on the approval letter of the Borough Manager.

§ 141-10 Owner to assume liability.

The property owner shall assume all liability for the maintenance, care and replacement of the tree and for the safety of all pedestrians.

§ 141-11 Maintenance of tree opening required.

The Borough Manager may revoke the permit and require sidewalk repairs could the property owner fail to maintain the tree opening and keep it clean and neat.

§ 141-12 Notice requirements.

Notice to the occupant of the premises shall constitute notice to the property owner.
