Upon the effective date hereof, it shall be
unlawful for any person owning, operating or having possession or
control of any commercial establishment within the City of Northfield
to utilize kerosene space heaters labeled for unvented use without
obtaining a permit from the Fire Protection Inspector of the City
of Northfield.
Upon the effective date hereof, it shall be
unlawful for any person owning, operating or having possession or
control of any commercial establishment within the City of Northfield
to utilize kerosene space heaters which have not been tested and approved
by Underwriters' Laboratories.
Upon the effective date hereof, it shall be
unlawful for any person owning, operating or having possession or
control of any commercial establishment within the City of Northfield
to place a kerosene space heater tested and approved by Underwriters'
Laboratories and for which a building permit has been obtained from
the Fire Protection Inspector in an area of public access, such as
but not limited to aisles, walkways, hallways and rest rooms, an unattended
area or in any area in which flammable or combustible materials are
stored. In no event shall any kerosene space heater be placed less
than three feet from any curtain, drapery, paper, furniture or other
such item.
As used in this chapter, the following terms
shall have the meanings indicated:
COMMERCIAL ESTABLISHMENT
Shall be an all-inclusive term, and is intended to include
all mercantile, business and assembly buildings.
OWNING, OPERATING OR HAVING POSSESSION OR CONTROL
Shall be all-inclusive, and includes but is not limited to
one who owns, rents, manages, operates or is in possession and control
of a commercial establishment within the City of Northfield. Common
sense meanings are to be applied. Where a property owner does not
have possession or control of the property as a result of a leasing
agreement or other such arrangements, unless the property owner has
supplied the kerosene space heater which violates the terms of this
chapter, the person having possession and control of the property
shall be presumed to be the responsible party.
PERSON
Any individual, entity or corporation recognized by law and
owning, operating or having possession or control of or over any commercial
establishment located within the City of Northfield.
PUBLIC ACCESS
Any and all areas where a member of the public may come in
contact with a kerosene space heater.
UNATTENDED AREA
Shall be all-inclusive, and includes but is not limited to
areas such as storerooms, closets and other similar locations. "Unattended"
is also intended to preclude operation of a kerosene space heater
within any commercial establishment when the establishment is closed
for business and no one is present on the premises.
The penalty for violation of any provision of this chapter shall be as set forth in Chapter
1, General Provisions, §
1-15.
It shall be unlawful to store kerosene within
the interior of any commercial establishment.
