Pursuant to the Inland Wetlands and Watercourses Act of the State of Connecticut, No. 155 of the Public Acts of 1972, as amended (hereinafter the "Act"),[1] there is hereby established, in the Town of Guilford, the Guilford Inland Wetlands Commission (hereinafter the "Commission").

A. 
The Commission shall consist of one member or alternate member of the Guilford Planning and Zoning Commission, one member of the Guilford Conservation Commission and five additional members who shall be electors and residents of the town.
B. 
Each member shall be appointed by the Board of Selectmen for a term of four years, such term to run from the first day of March in the year of appointment; provided, however, that the initial term of office of a member appointed to a newly created membership position may be less than four years; provided, further, that the terms of office of the representatives of the Planning and Zoning Commission and the Conservation Commission shall not exceed their respective terms of office on such Commissions. Terms of office shall be established to expire as nearly as possible at regularly staggered annual intervals. Members of the Commission presently serving terms on the effective date hereof shall continue to serve until the expiration of their terms.
C. 
Members of the Commission shall serve without compensation but shall be entitled to reimbursement for necessary expenses incurred in the performance of official duties.
The Board of Selectmen shall not remove a member of the Commission except for good cause and, upon request of such member, only after public hearing. Failure to attend four consecutive meetings of the Commission shall constitute good cause for removal.
Any vacancy in the membership of the Commission which may result from the death, resignation or removal of a member or from any other cause shall be filled for the unexpired term of such member by the Board of Selectmen. Vacancies created by the death, resignation or removal of a member who is a representative of the Planning and Zoning Commission or Conservation Commission shall be filled with another representative of such commission.
A. 
The Commission shall promulgate, on or before March 1, 1974, such regulations as are necessary:
(1) 
To provide for the manner in which the boundaries of the inland wetlands and watercourses in the Town of Guilford shall be established and amended or changed; and
(2) 
To protect the inland wetlands and watercourses within the territorial limits of the town.[1]

B. 
Said regulations shall be in conformity with the Act and with regulations promulgated pursuant to the Act by the Commissioner of Environmental Protection of the State of Connecticut.
The Commission shall have all of the powers and be subject to all of the duties as may be conferred or imposed by a municipality upon its duly authorized inland wetlands agency pursuant to the Act, including all incidental powers necessary to enforce rules and regulations and to carry out the purposes of the Act.[1]

In accordance with Section 4-10(a) of the Charter of the Town of Guilford and as authorized by Section 22a-42(c) of the Connecticut General Statutes, as amended, there shall be three alternate members of the Guilford Inland Wetlands Commission, who shall have all of the powers and duties vested in alternate members of Inland Wetlands Commissions by the General Statutes of the State of Connecticut, as the same may be amended from time to time, and as provided in the ordinance enacted by the Board of Selectmen on October 23, 1973, creating an Inland Wetlands Commission, as amended.[1]

Said three alternate members shall be appointed by the Board of Selectmen in accordance with Section 4-1 of the Charter of the Town of Guilford.
Alternate members of the Guilford Inland Wetlands Commission shall be electors and residents of the Town of Guilford and shall vacate their positions on ceasing to be electors or residents of the Town of Guilford.
One member of the original three alternate members shall be appointed for a term of two years, one alternate member for a term of three years and one alternate member for a term of four years, and, thereafter, each alternate member shall be appointed for a term of four years. Each member shall continue to hold office until his or her successor had been appointed and has qualified.
Alternate members may be removed for cause by the Board of Selectmen in accordance with the procedures set forth in Section 4-11 of the Charter of the Town of Guilford.
Said alternate members of the Guilford Inland Wetlands Commission shall serve without compensation, except that necessary expenses incurred in the performance of their duties may be paid from an appropriation authorized for the purpose.
