No person shall feed, harbor or shelter raccoons, feral cats,
foxes and coyotes within the Town of Guilford, unless:
A. Said person is licensed and in good standing with the Connecticut
Department of Energy and Environmental Protection as a wildlife rehabilitator
pursuant to C.G.S. §§ 26-7 and 26-54, complies with
all wildlife rehabilitator application and permit requirements as
set forth by the Connecticut Department of Energy and Environmental
Protection, and complies with all handling guidelines and disease
prevention protocols developed by the State of Connecticut Rabies
Advisory Committee; and
B. Said person's facility for wildlife rehabilitation, and all
rehabilitation efforts, remain in compliance with the Guilford Zoning
Regulations, Connecticut Public Health Code and the Town of Guilford
Health Code.
No person or business entity shall leave waste food products and containers, garbage or other similar refuse attractive to the animals set forth in §
131-5 outside of an enclosed structure unless the same are contained within appropriate trash or refuse receptacles so maintained as to minimize access by such animals.
The Director of Health is authorized to enforce the provisions of this article and to issue warnings, citations and fines as set forth in §
131-8.
Any person or business entity that violates any provision of
this article shall be subject to citation and a fine issued by the
Director of Health of not more than $100 for each violation, provided
that the violator has been issued a written warning for said violation.
Each day such violation continues shall constitute a separate violation.
Any person issued a citation shall be entitled to a hearing to contest
the citation. The Town hereby adopts the provisions of C.G.S. § 7-152c
for the establishment of a citation hearing process to contest citations
issued pursuant to this section. The procedures for notice, hearing,
disposition, appeal and enforcement shall be as set forth in C.G.S.
§ 7-152c. Said procedures are in addition to those administered
by the Connecticut Department of Public Health and provided under
any other applicable municipal, state or federal law or regulation.
