Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
No person, firm or corporation shall operate or maintain a food service establishment within the Town of Guilford until licensed by the Director of Health. The Director of Health shall collect for each license such fee as may be established from time to time by the Board of Selectmen.
A.
Application for a license to open a new food service establishment or to substantially remodel an existing food service establishment shall be made to the Director of Health on forms provided by the Director. Said application must be accompanied by a fee, which shall not be refundable. The applicant will state his or her name, address, location and type of proposed food service establishment.
B.
Submission of plans. Application for such a license will be accompanied by properly prepared plans and specifications for construction. The plans and specifications shall indicate the proposed layout, showing square footage available, arrangement and construction materials of work areas, walls, ceiling and floors and the type and model of fixed equipment and facilities. The Director of Health or his/her authorized agent shall approve the plans and specifications if they meet the requirements of this chapter and the Public Health Code of the State of Connecticut. No food service establishment shall be constructed, remodeled or altered except in accordance with plans and specifications approved by the Director of Health or his/her authorized agent.
C.
Each existing food service establishment shall apply annually at least 30 days before expiration of its existing license for renewal thereof to the Director of Health, on forms provided by the Director.
The Director of Health or his/her authorized agent, who shall be a certified food service officer, shall inspect the proposed food service establishment and, if the establishment complies with the requirements of this chapter and the Public Health Code of the State of Connecticut, shall issue a license to the applicant upon payment of the annual fee. Such license shall be framed and posted on the premises. No license shall be transferable, and such license will be surrendered to the Health Department upon closing of the establishment.
The Director of Health shall revoke any license to operate a food service establishment if the license holder does not comply with the requirements of the Public Health Code of the State of Connecticut.
The operator of any food service establishment who fails to comply with this chapter shall be fined not more than $99 for each day of such noncompliance.
