As used in this article, the following terms shall have the meanings indicated:
TOBEY POND AREA
That property of the Great Mountain Forest Corporation which is leased by the Town of Norfolk annually for the recreational use and enjoyment of its residents.

The Tobey Pond Area shall be open annually on those days established by the Board of Selectmen between the hours of 9:00 a.m. and 8:00 p.m. or one hour before sunset.
Each year the Board of Selectmen shall designate a Tobey permit and establish a permit fee. The permits may be obtained at the office of the Town Clerk and at other places as designated by the Board of Selectmen.
Each automobile having a Tobey permit affixed to its window or windshield in plain view may park where designated in the Tobey Pond Area. All other automobiles may be towed away at the owner's expense. No more than 40 vehicles shall be allowed to park in the Tobey Pond Area at any one time.
Picnics and lunches are permitted at the picnic tables on a first-come-first-served basis. Food shall not be permitted on the beach. All trash and litter shall be placed in containers. No glass bottles or containers of any types are allowed on the beach.
Swimming is permitted in roped areas designated by lifeguards. All swimmers shall be subject to rules and regulations as from time to time established by the lifeguards. All orders of lifeguards are to be strictly obeyed. Swimming devices, such as inner tubes, air mattresses, kick boards, beach balls, snorkels, face masks and other buoyant objects or flotation devices, are prohibited except for Coast-Guard-approved life jackets securely attached to the swimmer unless used for water safety instruction during an approved class. The lifeguard may suspend swimming rights of any person who violates rules or endangers the safety of another.
The lifeguard or other Town attendant may cause to be removed from the Tobey Pond Area any person who, by action or dress, disturbs the enjoyment or peace of the Tobey Pond Area by other persons.
