The Mayor shall appoint and may remove a Tree Warden who shall have all the powers and duties provided by Section 23-59 of the Connecticut General Statutes.
The powers and duties of the Tree Warden shall include, but not be limited to, the following:
A. 
The care and control of all trees and shrubs, in whole or in part, within the limits of any public road, public right-of-way or public grounds except those along state highways and those within the limits of Town of Wallingford parks unless authorized by the Director of Recreation.
B. 
Said care and control extends to such limbs, roots or parts of trees and shrubs as extend into or overhang the limits of any such public road, public right of way or public grounds.
C. 
The removal of all illegally erected signs or advertisements placed upon poles, trees or other objects within any public road, public right-of-way or public grounds.
D. 
The removal or pruning of trees or shrubs that cause sightlines for stopped vehicles to be impeded or reduced relative to their ability to see approaching vehicular traffic on the cross street.
E. 
The removal or pruning of any other trees or shrubs, in whole or in part, when deemed necessary for the safety of the public.
F. 
With approval of the Mayor, the removal of any trees or other plants within the limits of any public road, public right-of-way or public grounds that are particularly obnoxious as hosts of insects or fungus pests.
A. 
Unless the tree or shrub poses an immediate hazard to public safety, the Tree Warden shall, at least five days before such removal or pruning, post notice on the tree or shrub stating the Tree Warden's intention to remove or prune the tree or shrub.
B. 
Upon objection in writing to the Tree Warden by any person, firm or corporation, the Tree Warden shall hold a public hearing after reasonable notice to interested persons and posting of hearing notice upon such tree or shrub.
C. 
Within three days after such hearing, the Tree Warden shall render decision sustaining or overruling the objection.
D. 
Any party aggrieved by such decision may, within 10 days, appeal to the Superior Court for the Judicial District of New Haven.

Pursuant to the authority § 7-148 of the Connecticut General Statutes, the Sidewalk Inspector shall have concurrent jurisdiction over shrubs, tree limbs and other plant growth that encroach upon any public sidewalk.
