As used in this chapter, the following words shall have the meanings indicated:
APPROVEDApproved as applied to material, device or method of construction shall mean approved by the Building Official under the provisions of this chapter or approved by other authority designated by law to give approval in the matter in question.
BASEMENTA portion of the building partly underground, but having less than half its clear height below the average grade of the adjoining ground. (See "cellar.")
BUILDING CODEThe building code officially adopted by the legislative body of this jurisdiction; or such other code as may be officially designated by the legislative body of the jurisdiction for the regulation of construction, alteration, addition, repair, removal, demolition, use, location, occupancy and maintenance of buildings and structures.
CELLARThe portion of the building partly underground, having half or more than half of its clear height below the average grade of the adjoining ground.
DEVELOPED PARCELAny improved parcel, which has residential, office, commercial, or manufacturing/industrial buildings located thereon.
DORMITORYA building arranged or used for lodging six but not more than 20 individuals having a common toilet and bathroom facilities.
DWELLINGSC. MULTIFAMILY DWELLINGA building arranged, intended or designated to be occupied by three or more families living independent of each other with individual housekeeping units and common areas as well as individual units.
DWELLING UNITOne or more rooms arranged for the use of one or more individuals living together as a single housekeeping unit, with cooking, living, sanitary and sleeping facilities.
ENVIRONMENTALLY INVASIVE PLANTSNonnative or native plants that multiply rapidly, damage the surrounding ecosystem or are otherwise harmful to the public health, safety, and welfare and which are identified as such by the Director of Public Services.
EXTERIOR PROPERTY AREASThe open space on the premises and on adjoining property under the control of owners or operators of such premises.
EXTERMINATIONThe control and elimination of insects, rodents or other pests by eliminating their harborage places; by removing or making inaccessible materials that may serve as their food; by poison spraying, fumigating, trapping or by any other approved pest-elimination methods.
FAMILYA group of persons related by blood, marriage or adoption within and including the degree of first cousins, but provided that if they are not so related, a family may consist of no more than five persons.
GARBAGEThe animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.
GROSS FLOOR AREAThe total area of all habitable space in a building or structure.
HABITABLE ROOMA room or enclosed floor space arranged for living, eating and sleeping purposes (not including bathrooms, water closet compartments, laundries, pantries, foyers, hallways and other accessory floor spaces).
HOTELA building arranged or used for sheltering, sleeping or feeding for compensation of more than 20 individuals.
INFESTATIONThe presence, within or contiguous to a dwelling, multifamily dwelling, dwelling unit, rooming house, rooming unit, or premises, of insects, rodents, vermin or other pests.
MOTELFor purposes of this chapter, a motel shall be defined the same as a hotel.
OCCUPANTAny person over one year of age (including owner or operator) living and sleeping in a dwelling unit or having actual possession of said dwelling or rooming unit.
OPENABLE AREAThe part of a window or door which is available for unobstructed ventilation and which opens directly to the outdoors.
OPERATORAny person who has charge, care or control of a multifamily dwelling or rooming house, in which dwelling units or rooming units are let or offered for occupancy.
OWNERAny legal entity having a legal or equitable interest in the freehold or lesser estate therein, including, but not limited to, the following: a mortgage or vendee in possession, assignee of rents, receiver, executor, trustee, lessee or other person, firm, partnership, limited liability partnership, or corporation or limited liability corporation in control of a building, or their agents.
PERSONAny legal entity, including, but not limited to, the following: an individual, firm, partnership, limited liability partnership, association, trust, joint-stock company, corporation, or limited liability partnership, or successor of any of the foregoing.
PLUMBING OR PLUMBING FIXTURESWater-heating facilities, water pipes, gas pipes, garbage and disposal units, waste lavatories, bathtubs, shower baths, installed clothes washing machines or other similar equipment, catch basins, drains, vents or other similarly supplied fixtures, together with all connections to water, gas, sewer or vent lines.
PREMISESA lot, plot or parcel of land, including the building or structures thereon.
PROHIBITED VEHICLESAny vehicle which is either inoperable, dismantled, wrecked, displaying expired registration or no registration for at least 30 days expired, missing major components (engine, transmission, tires/wheels, exterior lights, body panels, hoods, doors, fenders), inoperable in a manner for which it was designed, and is situated on private property. Vehicles otherwise meeting this definition and which are stored in a garage or fully enclosed structure shall not be considered "prohibited vehicles" for the purpose of this chapter.

RENTAL PROPERTYFor the purpose of this Code, the term "rental property" shall be interpreted as property which contains rental units.
RESIDENCE BUILDINGA building in which sleeping accommodations or sleeping accommodations and cooking facilities as a unit are provided, except when classified as an institution under the building code.
ROOMING HOUSEAny residence building or any part thereof containing one or more rooming units, in which space is let by the owner or operator to more than five persons who are not members of the family. (See "dwellings" and "boardinghouse.")
ROOMING UNITAny room or group of rooms forming a single habitable unit or intended to be used for living and sleeping, but not for cooking or eating purposes.
RUBBISHCombustible and noncombustible waste materials except garbage; and the term shall include the residue from the burning of wood, coal, coke and combustible materials; paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery, plastics and synthetic material, and dust and other similar materials.
SUPPLIEDInstalled, furnished or provided by the owner or operator.
UNDEVELOPED PARCELAny improved or partially improved parcel, which has no residential, office, commercial, or manufacturing/industrial buildings, or any structures located thereon.
VENTILLATIONThe process of supplying and removing air by natural or mechanical means to or from any space.
B. NATURALVentilation by opening to outer air through windows, skylights, doors, louvers or stacks without wind-driven devices.
WEEDSDo not include the following:
A. Ornamental shrubs and trees, provided that such ornamental shrubs and trees are maintained in good order and condition.
B. A wildflower meadow; provided, however, that a wildflower meadow abutting a developed parcel shall be reasonably maintained at all times and shall be no less than 15 feet from the property line of the parcel on which such wildflower meadow is located.
WILDFLOWER MEADOWIdentified as such by the Director of Public Services from time to time, and native grasses, which are grown in a meadow, field, or garden, but shall not include environmentally invasive plants.
WORKMANLIKEWhenever the words "workmanlike state of maintenance and repair" are used in this chapter, they shall mean that such maintenance and repair shall be made in a reasonably skillful manner.
YARDAny open area outside of any dwelling, the use of which is incidental thereto.
