This chapter is authorized by § C-4B
of the Town Charter.
It shall be unlawful for any person to install
or use gasoline or diesel storage fuel tanks, either above or below
ground, within the corporate limits of the town.
The prohibitions of §
73-2 shall not apply to such minimal quantities (20 gallons) of fuel utilized for day-to-day operation of lawn mowers and watercraft. It shall not apply to heating oil or propane gas utilized for heating. Such authorization is subject to the condition, however, that such storage and use is in compliance with the fire and safety codes of the National Fire Underwriters Association. Tanks in vehicles and boats are exempt from the provisions of §
73-2 of this chapter when used solely for the operation of the vehicle or boat.

Any person violating the provisions of this
chapter shall be subject to a civil penalty of not less than $25,
nor more than $100, plus court costs. Each day of continued violation
shall be considered as a separate offense.
