Combining of lots shall follow the procedure for approval by the Commission
as outlined within these regulations.
No existing property line shall be moved, relocated, extended or erased
nor shall a new property line be created without first obtaining approval
of the Commission by the procedures outlined within these regulations.
Subdivisions of land shall be recorded in the Office of the Recorder
of Deeds, Sussex County, Delaware.
An unreduced copy of the approved, recorded plat of all subdivisions
shall be filed in the Office of the Town of South Bethany.
Proposed new subdivisions shall be classified by the Town Building Inspector
as a partitioning, combining of lots, minor subdivision, major subdivision
or planned residential development at the time of application.
Application forms will be provided by the town for all types of subdivisions,
must be completely executed, on file with the Town of South Bethany and a
matter of public record no less than 20 days before the date of review by
the Commission. To be complete, an application must contain the signed application
form, payment of the application fee and all required plans and supporting
documents. Incomplete applications shall not be reviewed by the Commission.
No subdivision shall be approved which would create or cause to exist
lots or parcels of ground within or without the subdivision that are not in
conformance with the requirements of these regulations or Zoning Ordinance.
No construction of any improvements, as shown in the application, shall
be started, nor shall any sign be erected, nor shall any material or equipment
be stored on the property under application until the application has been
approved by the Commission.
Property monuments shall be either:
A. Reinforced concrete of a size no less than four inches
by four inches in cross section and no less than 36 inches in length; or
B. A solid iron rod of a size no less than 5/8 inches in
diameter and no less than 36 inches in length.
