A. 
Application. Subdividers intending to partition a parcel of ground shall file a complete application with the Town of South Bethany no less than 20 days before the date of review. Plans required must be drawn and sealed by a professional engineer or a professional land surveyor licensed to do such work in the State of Delaware. The subdivider must submit eight copies of a plat of the parcel to be partitioned showing the new property line to be established and any structures, watercourses, ditches or utility easements on the property and one recordable plat of each new parcel of ground resulting from the partitioning. The appropriate fee must accompany the application.
B. 
Public hearing and notice. A public hearing shall be held. At least 15 days before the hearing notice thereof shall be posted on the property for which the subdivision is sought and should be no less than 81/2 by 11; on the bulletin board of the town; and at four other public places in the town. The notice shall contain at least the name of the property owner, the geographic location of the subject property, the subdivision or other matter requested and the date, time and place of the hearing. The notice shall also be published in a newspaper of general circulation in the town at least 15 days prior to the hearing. A copy of the notice shall be mailed to the adjacent property owners of property within 200 feet of the subject property at their addresses shown on the town tax records. A minimum of five adjacent property owners must be notified at least 15 days prior to the hearing. The owner of the subject property shall be mailed a notice of the hearing at the address shown on the town tax records. Copies of the notices should be sent, by certified mail, to the owner and to the adjacent property owners.
C. 
Review procedure. A review of an application for partitioning shall not be considered a final review. If approved, two plats representing the new parcels shall be signed and dated by the Chairman of the Commission.
D. 
Recording. One of the approved plats shall be recorded in the Office of the Recorder of Deeds, Georgetown, Delaware, within seven days from the date of approval by the Commission.

Application. Subdividers intending to combine two or more, or portions of two or more, lots of records into one lot of record shall file an application with the Town of South Bethany no less than 20 days prior to the date of review by the Commission. The application must contain:
(1) 
The completed application form.
(2) 
The prescribed fee.
(3) 
Eight copies of a plat of the lots or parcels as presently recorded showing the placement of any existing buildings or structures.
(4) 
Eight copies of a plat showing the new lot or parcel.
(5) 
Eight copies of a plat of any lot or parcel which is dimensional affected by the combining, two of each of which shall be suitable for recording with space for a date of approval and signature of the Chairman of the Commission. All plats must be sealed by a professional engineer or a professional land surveyor licensed to do such work in the State of Delaware.

Public notice. Public notice of a review of a proposed combining of lots shall be posted in at least four public places within the town. Such notice shall be posted no less than 15 days prior to the preliminary plan review and shall contain at least the name of the subdivider, classification and geographical location of the proposed subdivision and the time, date and location of the review hearing by the Commission.
C. 
Review procedure. The Commission shall review the submitted plans for conformance with this and other town regulations and ordinances. If approved, two copies of each plat representing new lots or parcels of ground shall be signed and dated by the Chairman of the Commission.
D. 
Recording. One of the approved plats shall be recorded in the Office of the Recorder of Deeds, Georgetown, Delaware, within seven days from the date of the Commission's approval.

Required plans must be drawn by a professional engineer or a professional land surveyor licensed to do such work in the State of Delaware. The subdivider must submit:
(1) 
Eight copies of a plat showing the entire property of the subdivider and the lots constituting the minor subdivision.
(2) 
Eight copies of the lots constituting the minor subdivision.
(3) 
Two copies of the minor subdivision suitable for signature of the Commission Chairman and recording in the Recorder of Deeds Office in Georgetown, Delaware.
(4) 
The prescribed fee.

Public notice. Public notice of a review of a proposed minor subdivision shall be posted in at least four public places within the town. Such notice shall be posted no later than 15 days prior to the preliminary plan review and shall contain at least the name of the subdivider, classification and geographical location of the proposed subdivision and the time, date and location of the review hearing by the Commission.
C. 
Review procedure. The Commission may approve the final plan of a minor subdivision at one review.
D. 
Recording. The approved plat shall be recorded in the Office of the Recorder of Deeds, Georgetown, Delaware, within seven days from the date of approval by the Commission.

C. 
Review procedure. A major subdivision is subject to and must satisfy all the requirements and procedures specified in Article V of these regulations.
