The Town parks shall be open daily to the public during the
hours of 6:00 a.m. to 10:00 p.m.; and it is unlawful for any person,
other than Town personnel conducting Town business thereon, to occupy
or be present in any park during any hours in which the park is not
open to the public, without prior written permission of the Mayor
and the Town Council.
It is unlawful to drive or park a motor vehicle of any kind
in any park or on any other Town-owned property except on a street,
driveway or parking space or lot. This section shall not apply to
motorized wheelchairs or similar small machines necessary for the
use of the parks by handicapped persons; nor shall it apply to Town
vehicles being operated by Town personnel conducting Town business.
A.
It is unlawful for any person or persons to park any vehicle or structure,
including tents and sleeping bags, so designed or constructed in such
a manner as will permit occupancy thereof as sleeping quarters, and
to use the same for the purpose of overnight camping or sleeping or
to sleep overnight in any Town park or on any Town street or other
Town property without prior written permission of the Mayor.
B.
This section shall not apply to that portion of the Jackson Avenue
Park designated specifically for camping. Tent camping is allowed
at such park subject to rules and regulations adopted by resolution
of the Town Council.
It is unlawful to bring any horse, or to allow any unattended
horse to stray, into any park of the Town.
It is unlawful to start or maintain a fire on any Town property
except in previously constructed fireplaces or existing fire rings.
All lawfully located fires shall become unlawful unless they comply
with the following:
A.
Fires shall be built, used and maintained so as to minimize fire
hazard and smoke nuisance.
B.
No open fire shall be permitted on Town property except in facilities
provided.
C.
No open fire shall be left unattended within the Town limits of the
Town of Pinedale.
D.
No fuel shall be used or material burned which emits dense smoke
or objectionable odors.
The Department of Public Works is authorized to erect official
signs calling attention to the public of the acts made violations
of this chapter.
A.
Any portion of any Town park may be reserved in advance for a permitted
use for a specific day and time on a first come, first served basis.
Any applicant making such reservation shall complete the reservation
form available in the office of the Town Clerk. Reservations will
only be accepted during regular business hours at the Town Hall.
B.
A reservation fee and a deposit fee are required, and no reservation
is complete until all fees have been paid. The deposit fee shall be
refunded, providing the applicant fulfills all required terms and
conditions of the permit.
C.
The successful applicant shall post the permit in the appropriate
park on the morning of the event where it is visible to the public.
Areas not reserved shall remain open to the public.
D.
All park rules and regulations of this chapter shall be followed
by the applicant, including completing all activities by 10:00 p.m.
on the day reserved. Any damage to turf areas, trees, sprinklers,
structures, or general misuse of the park; or failure to clean up
the park after use, is the responsibility of and will be charged to
the applicant/responsible person, and/or the reservation deposit retained
by the Town to pay for such repair/cleanup.
E.
The person to whom the permit is issued shall be liable for any loss,
damage, or injury sustained by any person, by reason of the negligence
of the person to whom the permit has been issued.
F.
The Town shall have the authority to revoke a permit upon finding
a violation of any rule, ordinance or standard. The sheriff or any
sheriff's deputy may revoke a permit upon finding of a violation
of any Town ordinance.
G.
There shall be no commercial use of or activity in any park without
the express permission of the Town Council.
