No person shall keep, deposit or store any grain,
fertilizer, agricultural produce or agricultural by-products on any
premises within the City of Breckenridge unless it is kept within
a suitable storage facility and handled, deposited or stored as to
prevent any danger of fire and so as not to be injurious to health
and so as not to be in violation of any other ordinances or law.
As used in this article, the following terms
shall have the meanings indicated:
SUITABLE STORAGE FACILITY
Either a permanent facility recognized and approved by City
Building Code or temporary structure receiving prior approval from
the City Codes Administrator assuming that said structure does not
create a danger of fire and is not injurious to health and not in
violation of other ordinances or law.
All grain, fertilizer, agricultural produce
or agricultural by-products kept, deposited or stored in violation
of this article is hereby declared to be a nuisance.

If any person violates any provision of this article, the City may follow the abatement procedures established in §
118-25.
Any person who maintains a nuisance in violation of the provisions of this article, or who fails to abate such nuisance when notified by the Codes Administrator, shall be guilty of a misdemeanor and upon conviction thereof, shall be punished as provided in Chapter
1, General Provisions, Article
I, General Penalty.
