As used in this article, the following terms shall have the meanings indicated:
LIBRARIAN
The individual employed by the Beach Haven Free Public Library as a specialist in the care and management of a library.
LIBRARY
The Beach Haven Free Public Library located within the Borough of Beach Haven, County of Ocean, State of New Jersey.
PERSON
Includes the singular and the plural and shall also mean and include any person, firm or corporation, association, club, partnership or society or any other organization.
A. 
All persons borrowing literary, musical, artistic or reference materials (as books, manuscripts, magazines, recordings, film or the like) from the Beach Haven Free Public Library shall comply with the requirements and policies of the librarian for the borrowing and return of those materials to the Beach Haven Free Public Library.
B. 
If any person is delinquent more than 14 days in returning the materials borrowed from the Beach Haven Free Public Library, then in that event the librarian may, at the librarian's discretion, notify said person by certified mail, return receipt requested, to return the borrowed material no later than 14 days from the date of the receipt of the letter. If the person fails to comply with the request of the librarian, then the librarian may, thereafter, sign a complaint in the Municipal Court of the Borough of Beach Haven for the person's failure to return the borrowed material.
Any person failing to comply with the request of the librarian to return the material, in accordance with the letter authorized to be sent by the librarian as set forth in § 117-2 above and upon conviction of the same in the Municipal Court of the Borough of Beach Haven, the Municipal Court Judge may, in the Judge's discretion, fine the person an amount not to exceed $25 per day per item from the date upon which the book, article or other material should have been returned in accordance with the written demand.
