Editor's Note: Ordinance No. 2254, adopted 12-14-1999, provided that the Shade Tree Commission be abolished and the duties that were assigned to the Commission be reassigned to the Shade Tree Committee. See also Ch. 291, Trees.
There is hereby created in the Borough of Bergenfield a committee to be known as the "Bergenfield Shade Tree Committee," which shall consist of members, who are residents of this municipality, to be appointed by the Mayor and to serve without compensation.
The terms of office of the members of said Committee shall be one year.
The Shade Tree Committee shall organize annually by the election of one of its members as Chairperson, and the appointment of a clerk, who need not be a member of the Committee.
The Shade Tree Committee shall have the following powers:
A. 
To exercise full and exclusive control over the regulation, planting, care of shade and ornamental trees and shrubbery now located, or which may hereafter be planted in or upon any public street, park, or parkway, except county parks or parkways, including the planting, trimming, spraying, care and protection of the same for the public good.
B. 
To regulate and control the use of the ground surrounding the same, so far as may be necessary for their proper growth, care and protection.
C. 
To require the removal of any tree, or part thereof, dangerous to public safety, at the expense of the owner of the tree.
D. 
To care for and control such parks and parkways; encourage arboriculture; make, alter, amend and repeal, in the manner prescribed for the passage, alteration, amendments and repeal of ordinances by the Borough Council, any and all ordinance necessary or proper for carrying out the provisions hereof.
The Shade Tree Committee, at its formation by creation of this article, shall consist of the members of the Shade Tree Commission that are presently serving.
