All barbershops located in the Borough, shall be closed
to the public and business therein prohibited before the hour of 8:00 a.m.
and after the hour of 6:30 p.m. on all weekdays, except as hereinafter mentioned.
On Saturdays, all barbershops shall be closed to the public and business therein
shall be prohibited before the hour of 8:00 a.m. and after the hour of 6:00
p.m.
Nothing in this section is intended to prohibit the rendering
of service to any patron after the closing hour, provided that the patron
was admitted to the barbershop before the closing hour.
Barbershops shall be closed all day on Sunday, Wednesday,
New Year's Day, Memorial Day, Independence Day, Labor Day, Presidential Election
Day, Thanksgiving Day and Christmas Day. If holidays occur during the week
or are observed on a day other than Wednesday, barbershops may be open during
the regular weekday hours on Wednesday in that week. If any holiday falls
on a Sunday, the closing hour for such holiday shall be observed on the Monday
following.
Any person, whether owner, proprietor or employee, who
shall open or permit to be opened, or who shall serve any patron during the
hours in which it is herein provided that the barbershops shall be closed,
shall upon conviction thereof, pay a fine not exceeding $25, or imprisonment
in the county jail, not exceeding 10 days.
In the event that any action complained of has been approved
by or has been taken pursuant to a state statute, or local ordinance, or if
action has been approved by the courts of the State of New Jersey, then no
charges of possible violation of this chapter shall be brought against any
officer of the Borough.
