As used in this article, the following terms shall have the meanings indicated:
SOLICITOR
A person, also known as a "canvasser," whether a resident of the Borough or not, traveling either by foot, wagon, automobile, motor truck, or any other type of conveyance, from place to place, from house to house or from street to street, who takes or attempts to take orders for sale of goods, wares and merchandise, personal property of any nature whatsoever for future delivery, or for services to be furnished or performed in the future, whether or not the individual has, carries or exposes for sale a sample of the subject of the sale, and whether or not he accepts an advance payment for the goods. Any person taking a poll or a survey from house to house or on the streets, or distributing advertisements or handbills, is included.
No person shall canvass, solicit or call house to house within the Borough limits without first having received a written permit and identification card from the Chief of Police.
In addition to the information required by § 198-2, the application for a solicitor's license shall indicate the place where the goods or property proposed to be sold or orders taken for the sale thereof are manufactured or produced, where such goods or products are located at the time the application is filed, and the proposed method of delivery.
The identification card when issued shall be displayed by the permittee on request at all times while actually engaged in canvassing, soliciting, distributing or calling from house to house within the Borough limits.

A. 
The permit fee for each solicitor shall be $100 for each consecutive thirty-day period.
B. 
No fees shall be charged to charitable and/or not-for-profit organizations recognized by the State of New Jersey and/or the federal government. This shall include those individuals exercising their rights in favor of a political candidate or cause.
Permittees shall have the right to canvass within the Borough only on weekdays and Saturdays during the hours from 9:00 a.m. to 6:00 p.m. or sunset, whichever first occurs.
The terms of this article shall not be held to include the acts of persons selling personal property at wholesale to retailers in the articles, nor to merchants or their employees, engaged in the act of delivering newspapers, advertising circulars or goods in the regular course of the business or the collection of payments therefor; nor to any public utility which is subject to regulation by the Board of Public Utility Commissioners of New Jersey and its duly authorized representatives or agents when carrying an identification card, badge or insignia issued by such public utility; nor to any religious, public, civic or charitable organization, nor any individual engaged in such activity.

A. 
Any person who shall violate § 227-14 shall, upon conviction thereof, be punished by a fine of not less than $250 and not more than $500 for a first offense.
B. 
The second or any subsequent offense shall be punishable by a fine of not less than $400 and not more than $500 and/or imprisonment for up to six months in jail, or both.
