Whenever any words and phrases are used in the chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
All former traffic ordinances of the Borough of Bergenfield are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance repealed prior to the taking effect of this chapter.
Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the municipality.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $250 or imprisonment for a term not exceeding 15 days or both.
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

B. 
Commercial vehicles, construction equipment or vehicles over 26,000 pounds gross vehicle weight are prohibited from parking on any public street or other public right-of-way in the Borough, between the hours of 8:00 p.m. and 6:00 a.m. In addition no person shall park a commercial vehicle or construction equipment upon the public right-of-way or within 500 feet of residential dwellings and permit any motor, engine, compressor or other device to operate for more than 10 consecutive minutes or a total of 10 minutes within any two-hour period, during the aforementioned time frame.

(1) 
Trailers and semi-trailers. No person may park or stand, or cause to be parked or stood, any trailer or semi-trailer disconnected from a commercial vehicle on any street or public property in the Borough at any time.
(2) 
Public right-of-way. Public right-of-way shall include any dedicated or developed property used or intended for use as public streets, alleys or other means of public ingress, egress or passage whether the property of the Borough, county or state.
(3) 
The gross vehicle weight rating (GVWR) is the maximum operating weight/mass of a vehicle as specified by the manufacturer including the vehicle's chassis, body, engine, engine fluids, fuel, accessories, driver, passengers and cargo.
(4) 
Exemptions:
(a) 
Commercial vehicles or vehicles over 26,000 pounds gross vehicle weight engaged in deliveries or as support to an ongoing business activity such as construction or moving are exempt from the provision of this subsection, but only for the time reasonable and necessary to support the activity or make the delivery.
(b) 
Commercial vehicles typically used for passenger or commuting purposes (sedan, station wagon, small van, small pickups etc.) that are under 26,000 pounds are exempt from the provisions of this subsection.
(c) 
Privately owned recreational vehicles and boats shall not be regulated under this subsection unless the vehicles are being parked as part of a commercial activity such as repairs, sales or servicing or are being used for a commercial purpose.
(d) 
Commercial vehicles, construction equipment or vehicles over 26,000 pounds gross vehicle weight (GVW), when owned by a government/utility agency or operating under the authorization of said government/utility agency, where the drivers are required by their employment to operate said vehicle, are exempt from this subsection.
(5) 
Any vehicles or other construction equipment that is being used by any contractor/vendor that has been contracted by the Borough of Bergenfield to complete any Borough project may park said vehicles/equipment at the specified location, during the restricted times of this chapter, upon approval by the Bergenfield Police Department.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
B. 
Notification that the EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
C. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of the vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.
D. 
Violations and penalties. Any person convicted of a violation of a provision of this section or any supplement thereto shall be liable to a penalty of $55 for each day of occurrence.

A. 
A snow emergency shall exist whenever snow has fallen and the accumulation is such that it covers the street or highway. In addition to this, when weather conditions cause a state or condition of the street that is hazardous or dangerous to vehicular or pedestrian traffic even if the entire street or highway is not covered by snow shall constitute a snow emergency when declared by the Chief of Police or, in his absence, the ranking police officer in charge.
B. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
SNOW
Any precipitation depositing any accumulation and shall be deemed to include snow, sleet, hail, ice, freezing rain or any combination thereof.
SNOW TIRES
Tires with or without studs and having treads designed for use in snow which tread shall be of sufficient depth to accomplish the purpose for which the tire was designed.
C. 
Snow emergency declared. Upon the occurrence of a snow emergency as hereinabove defined, the Chief of Police or, in his absence, the ranking police officer shall have the authority to declare such emergency. Within one hour after such declaration, no person shall cause, permit, allow or suffer any vehicle owned or driven by him to become stalled or immobile on any portion of any street in the Borough of Bergenfield because of the failure of the vehicle to be equipped with snow tires or chains. The Chief of Police or the ranking police officer shall immediately inform the public of said snow emergency by issuing a press release to the local and metropolitan radio, television and news services.
D. 
Snow emergency routes. All streets of the Borough of Bergenfield are snow emergency routes upon which no parking shall be allowed during a snow emergency, and such parking prohibition shall remain in effect until after the snow has ceased or until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic or until otherwise terminated by the Chief of Police or, in his absence, the ranking police officer, in the same manner as declared in above.
E. 
Violations and penalties. Any person convicted of a violation of a provision of this section or any supplement thereto shall be liable for a penalty of $55 for each day of occurrence.

A. 
Purpose. The purpose of this section is to establish certain areas that are private property that open to the public or in which the public is invited that shall prohibit parking in areas designated as handicapped parking spaces for use by persons who have been issued special identification cards by the New Jersey Motor Vehicle Commission or a temporary placard issued by the Police Chief. No other person shall be permitted to park in these spaces.
B. 
Statutory authority. This article is enacted in accordance with N.J.S.A. 40:48-2.46, which does confer upon the Borough of Bergenfield the right to establish handicapped parking spaces and access lanes in order to preserve and safeguard the public health, safety, morals and welfare.
C. 
Signs, pavement markings: installation, maintenance and penalties. The owners of the premises referred to in § 299-15D below shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons which markings and signage shall be in accordance with ADA requirements as well as N.J.S.A. 39:4-197.(3)c. The cost of procurement and installation of the signs and pavement markings shall be that of the owner. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition, at no cost or expense to the Borough of Bergenfield. The owner shall be responsible for the repair and restoration, replacement of same, or a fine of $250 for each offense.
D. 
Areas covered. The following areas shall be designated as handicapped parking and shall be so marked by signs in conformance with the current Manual on Uniform Traffic Control Devices for Streets and Highways:

Penalties. Enforcement shall be pursuant to N.J.S.A. 39:4-138o. For violation of any provision of this section any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $250 for first offense and for subsequent offenses a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate or any combination thereof.
F. 
Tow away. Any vehicles parked in violation of the provisions of this section may be towed if so deemed to be a nuisance or a menace to the safe and proper regulation. The owner shall bear the reasonable cost of removal and storage which may result from such removal before regaining possession of the vehicle.

No person, whether licensed or unlicensed, will operate a gas or electric scooter that is not legally registered as a motor vehicle with the State of New Jersey on any municipal roadway, sidewalk, or recreation area within the confines of the Borough of Bergenfield, unless same is operated on private property with the express permission of the owner of that property.
B. 
Enforcement shall be pursuant to N.J.S.A. 39:4-203.

No person shall travel in the opposite direction on the below streets during school hours when barricades are in place with the exception for emergency vehicles in the event of an incident.

A. 
No person shall park a vehicle on the below street unless that person is a veteran:
Lilac Street 35 feet west of South Washington Avenue for 75 feet
B. 
No person shall park a vehicle on the designated areas below unless that person is a veteran and a recipient of a Purple Heart:
(1) 
Lilac Street within the vicinity of the designated area from Subsection A.
(2) 
8 Veterans Plaza and West Main Street (parallel to railroad tracks, behind DAV Building).
(3) 
Municipal parking lots at the following location (within Borough Hall Lot, adjacent to Borough Hall).
C. 
Violations and penalties. Any person convicted of a violation of a provision of this section or any supplement hereto shall be liable to a penalty of $55.

A. 
Purpose. This subsection establishes special parking licenses for certain Borough emergency vehicles, Borough vehicles used during the performance of official Borough duties, and personal vehicles of Borough employees, staff, and officials while performing their duties, subject to the conditions and requirements set forth herein.
B. 
Definitions. For the purposes of this subsection, the following terms are defined as:
BOROUGH EMERGENCY VEHICLES
Vehicles owned or operated by the Borough for emergency response purposes, including police, fire, and ambulance services.
BOROUGH VEHICLES
Vehicles owned or leased by the Borough and used for official Borough duties.
PERSONAL VEHICLES
Privately owned vehicles of Borough employees, staff, or officials used in the performance of their official duties.
SPECIAL PARKING LICENSE
A formal authorization issued by the Borough permitting the holder to park in designated areas while performing official duties, subject to the conditions set forth in this subsection.
TAG, PLACARD, or PLATE
The physical identifier issued by the Borough that must be displayed to indicate authorization under the special parking license.
C. 
Authorized vehicles. The following vehicles shall be authorized for special parking licenses:
(1) 
Borough emergency vehicles actively engaged in emergency response or other official Borough business.
(2) 
Borough vehicles being utilized for the performance of Borough duties.
(3) 
Personal vehicles of Borough employees, staff, and officials when actively performing duties of their office or employment.
D. 
Conditions for special parking licenses. Special parking licenses granted under this subsection shall be subject to the following conditions:
(1) 
Vehicles must be parked in a manner that does not create a danger to public safety or impede the free flow of traffic.
(2) 
Parking is only permitted in areas not specifically prohibited by other laws, ordinances, or traffic regulations.
(3) 
License holders must comply with all relevant Borough traffic and parking regulations.
E. 
Identification requirements. To exercise parking rights under a special parking license, the following identification requirements must be met:
(1) 
A tag, placard, or plate issued by the Borough must be displayed on the dashboard or in another conspicuous place within the vehicle, indicating the authority to park.
(2) 
The tag, placard, or plate shall include the following:
(a) 
The name of the issuing authority.
(b) 
The expiration date of the special parking license.
(c) 
A unique identifier corresponding to the authorized user.
F. 
Authorization process.
(1) 
Authorization for special parking licenses must be obtained through proper application to the Borough.
(2) 
Applicants must submit documents demonstrating their eligibility, including proof of employment, official status, or vehicle registration.
(3) 
Applications shall be submitted to the Clerk's Office and shall be forwarded to the Mayor or his/her designee for final approval.
(4) 
The Borough reserves the right to revoke or deny licenses if conditions for eligibility are no longer met.
G. 
Penalties.
(1) 
Unauthorized use of Borough-issued tags, placards, or plates shall result in the immediate revocation of the special parking license.
(2) 
Additional penalties, as provided by existing ordinances, may also apply, including fines and towing at the owner's expense.
(3) 
Repeat violations may result in a permanent ban from obtaining future special parking licenses.
