As used in this chapter, the following terms shall have the meanings
indicated:
COLLECTION DATES
Those dates set by the Director of the Department of Public Works,
or his designee, for the collection of leaves.
LEAVES
Any flattened plant structures which were attached to a stem and
functioned as a principal organ of photosynthesis. Leaves shall not include
any grass clippings, shrubbery, branches or root material.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other
way which is an existing state, county or municipal roadway and includes the
land between the street lines, whether improved or unimproved, and may comprise
pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas
within the street lines.
Leaves accumulated by residents of the Township of Bridgewater shall
be collected on a schedule to be established by the Director of the Department
of Public Works. Such schedule may be altered or amended from time to time
to conform to legal holidays and emergencies or as deemed necessary by the
Director.
The Director of Public Works, or his designee, may refuse to collect
any leaves which fail to meet the regulations set forth herein. In such event,
the person placing the refuse for collection shall be compelled to dispose
of the same at their own cost and expense within one week (or sooner if the
failure to dispose of the refuse in a timely manner poses a threat to the
health, safety and/or welfare of the residents) of such refusal by the Director
or his designee.
Placement of such leaves at the curb or along the street at any other
time or in any other manner is a violation of this chapter. If such placement
of leaves occurs, the party responsible for placement of the leaves must remove
the leaves from the street or said property shall be deemed in violation of
this chapter.
The provisions of this chapter shall be enforced by the Department of
Public Works, the Health Officer, the Department of Code Enforcement and/or
the Bridgewater Township Police Department.
Any person(s) who is found to be in violation of the provisions of this
chapter shall be subject to a fine not to exceed $1,000.
