A. 
Generally. No person shall exercise the business or trade of auctioneer, or sell any property at public auction or outcry within the City, without first having obtained a license to act as such auctioneer.
B. 
Exceptions. Nothing in this article shall:
(1) 
Prevent the Council from issuing a permit to a person who has been engaged in business in the City for at least one year to sell at public auction in his or her place of business from his or her own stock goods not purchased for the purpose of being sold at auction for such length of time not exceeding 10 days at any one time and between such hours and upon payment of such fee as the Council may fix; or
(2) 
Be deemed to require a license for the sale of property under a judgment, decree or order of any court, or to close any estate in the course of administration.
A. 
City Manager to issue. A license hereunder may be issued by the City Manager, upon application, for a period of not more than one year, upon payment of such fee as follows:
(1) 
For three months or less: $25.
(2) 
For over three months and not more than six months: $50.
(3) 
For over six months and not more than one year: $100.
B. 
Application. Any person who desires to obtain a license under this article shall make an application which shall include the following information:
(1) 
Name, address and age of applicant.
(2) 
Place of business, if auctions are to be conducted at a specific location.
(3) 
Statement of prior licenses as an auctioneer in this City or any other jurisdiction.
(4) 
Experience as an auctioneer, if any.
(5) 
Whether or not the applicant has been convicted of a crime or of any violation in the performance of his or her occupation as auctioneer.
(6) 
Such other information as the City Manager may require to determine the qualifications of the applicant to act as an auctioneer.
C. 
Denial of license. For good cause and after a report from the Chief of Police, the City Manager may refuse to issue a license subject to the provisions of Chapter 200, Licensing, of this Code.
Before any license hereunder is issued, each applicant therefor shall present to the City Manager for filing in the office of the City Clerk a duly approved bond in the sum of $1,000 to the effect that the applicant will well, truly and honestly conduct the business of such auctioneer.
The City Manager shall have authority at any time to revoke any license issued by him or her hereunder if it appears to him or her that the applicant therefor is not well, truly, honestly and fairly conducting the business of auctioneer and observing all laws of the State of New York and laws and ordinances of the City, as provided in Chapter 200, Licensing, of this Code.
No person procuring a license hereunder shall sell any personal property at public auction at any time except between the hours of 9:00 a.m. and 10:00 p.m.
Except as otherwise provided in this chapter or other applicable law, a violation of any provision of this chapter shall be punished as provided in Chapter 1, § 1-18 of this Municipal Code.
