A. 
Any vehicle used for the purpose of removing, transporting or disposing of sewage, sludge, human or animal excreta or industrial wastes, when parked, standing or otherwise left unattended within the City of Batavia, is hereby declared to be a nuisance.
B. 
The owner, operator, or both owner and operator, of such a vehicle, as hereinabove described, responsible for such a nuisance, shall be guilty of violation, as set forth in Chapter 1, General Provisions, Article II, General Penalty, of the City of Batavia Municipal Code.
C. 
In addition to or in the alternative, the City of Batavia may institute appropriate action to restrain, prevent, enjoin or use any statutory or common law method to abate such a nuisance.
Except as otherwise provided in this article, any person violating any provision of this article shall be punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment.
